AN ORDINANCE CORRECTING DISCREPANCIES BETWEEN TITLE 12 OF THE JONESBORO MUNICIPAL CODE AND ORDINANCE NO 1565, AND MAKING OTHER NECESSARY AND PROPER AMENDMENTS TO TITLE 12.

BE IT ORDAINED by the City Council of the Municipal Corporation of the City of Jonesboro:

 

SECTION 1: The first sentence of Jonesboro Municipal Code 12.04.01 is hereby amended to read:  There is hereby established and created a city commission to be known as “The Jonesboro Parks and Recreation Commission”.

 

SECTION 2: The following sentence is hereby inserted at the conclusion of Jonesboro Municipal Code 12.04.01 as the last sentence: “Each commissioner is required to file the oath required by law for public officials.”

 

SECTION 3: The following sentence is hereby inserted at the conclusion of the Jonesboro Municipal Code 12.04.03 as the last sentence: “The chairman of the commission may not serve two successive terms as chairman.

 

SECTION 4: The last sentence of Jonesboro Municipal Code 12.04.07 is deleted. Inserted in the place thereof is the following: “All rules, regulations, and schedules shall be promulgated and adopted by the Commission, subject to review of the City Council. All rules, regulations, and schedules shall become effective upon passage by the Commission.”

 

SECTION 5: All of Jonesboro Municipal Code 12.04.08, except the caption, is deleted.  Inserted in the place thereof is the following: “The Commission is authorized to receive funds for the use of the parts facilities by the general public or other charitable contributions, and the Commission is authorized to make reasonable charges for the use of parks facilities and for programs conducted under the auspices of the Commission.

 

All revenues received by the Commission shall be deposited with the Department of Finance and Administration.

 

All expenditures made by the Commission shall be made through the Purchasing Department of the City of Jonesboro, Arkansas, for any expenditure which exceeds the sum of $100.00. The Commission shall make all purchases and sell all property through the Purchasing Department of the City of Jonesboro, Arkansas.”

 

SECTION 6: All of Jonesboro Municipal Code 12.04.10 including the caption is deleted. Installed in the place thereof is the following: “Meetings. The Commission shall meet regularly each month or at a special meeting on the request of its chairman or any three of its members. Said meeting shall be attended by the Parts Committee of the City Council.”

 

SECTION 7: The following is adopted as Jonesboro Municipal Code 12.04.11: “Removal of member.  Any commissioner may be removed from cause upon a vote of two-thirds of the duly elected and qualified members of the City Council. Three consecutive absences from meetings of the Commission shall be prime facie cause for removal.”

 

SECTION 8: The following is adopted as Jonesboro Municipal Code 12.04. 12: “Scope of commission authority. In addition to those power enumerate herein above, the Jonesboro Parts and Recreation Commission shall operate all Jonesboro Parks and Recreation programs and all park facilities, including Craighead Forest Park.”

 

SECTION 9: The following is adopted as Jonesboro Municipal Code 12.04.13: “Personnel and directors. The Commission shall employ such personnel as deemed to be necessary for the operation of the parks facilities and recreational programs. The salaries and wages of “Parts” personnel shall be set by the Commissions.

 

The Parks Director shall be appointed by the Mayor and approved by a majority of the City Council and shall serve and hold office at the will and discretion of the Mayor or City Council. The Director’s salary shall be determined by the City Council.”

 

SECTION 10: The following is adopted as Jonesboro Municipal Code 12.04.14: “Further definition and limitation of powers of Commission.

 

CONTRACTING. The Commission shall not make a contract or enter into a contract without the approval of the City Council.  The Commission shall not have the authority or power to sell, mortgage, or encumber any real property, unless specifically authorized by the statutes of the State of Arkansas and approved by the Jonesboro city Council.

 

The Commission shall maintain, repair, establish, and supervise all parks and programs established, administered or operated by the Jonesboro Parks and Recreation Commission and shall conduct and manage all programs for the public welfare of the people of the City of Jonesboro, Arkansas and will utilize all property under its control to the best possible advantage”

 

SECTION 11: This Ordinance being necessary for the preservation of the public peace, health, and safety, an emergency is hereby declared to exist and it shall take effect from and after its passage.

 

PASSED AND ADOPTED this 4th day of June, 1990.
