AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORIES TO PARTICULAR WARDS; DECLARING ZONING FOR EACH ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of eight particular tracts to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on August 23, 1985; and
WHEREAS, said petition for the annexation of these lands was duly signed by the sole owner of all of the tracts to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on September 24, 1985, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated September 24, 1985, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of October 25, 1985.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead, County, Arkansas, by its order of September 25, 1985, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (CWL Annexation 8 Tracts of Land - Frierson)
TRACT 1: Beginning at the Northwest corner of the Northwest Quarter of the Northwest Quarter of Section 36, Township 14 North, Range 4 East; thence South along the Section line 1320 feet; thence East 1320 feet; thence North 1320 feet; thence West 1320 feet to the point of beginning, containing 40 acres, more or less.
TRACT 2: A part of the Southwest Quarter of the Southeast Quarter of Section 28, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Northeast Corner of the Southwest Quarter of the Southeast Quarter of said Section 28; thence South 0°41’ West 667.0 feet to the P.T. of a 3°39’ curve to the right; thence Southwesterly along said curve 196 feet to the P.T. of a 3°58’ curve to the left; thence Southwesterly along said curve 103.9 feet to the point of beginning proper; thence continue Southwesterly along said curve 100 feet to the North right-of-way line of U.S. Hwy. #63 Bypass; thence South 89°52’ West along said right-of-way line 100 feet; thence in a Northerly direction 100 feet; thence North 89°52’ East 100 feet to the point of beginning proper containing 0.23 acres.
TRACT 3: A part of the Northeast Quarter of the Southeast Quarter of Section 28, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Southeast corner of the Northeast Quarter of the Southeast Quarter; thence South 89°57’ West on the 40-acre line 150.0 feet; thence North 0°49’ East 130.0 feet; thence North 89°57’ East 150.0 feet to the South line; thence South 0°49’ West on the Section line 130.0 feet to the point of beginning, containing 0.45 acre.
TRACT 4: A part of the Southwest Quarter of the Southeast Quarter of Section 28, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Northwest corner of the Southwest Quarter of the Southeast Quarter of said Section 28; thence North 89°57’ East 323.4 feet to the point of beginning proper; thence North 89°57’ East 100 feet; thence South 0°42’ West 100 feet; thence South 89°57’ West 100 feet; thence North 0°42’ East 100 feet to the point of beginning proper, containing 0.23 acre.
TRACT 5: Part of the Southwest Quarter of the Northwest Quarter of Section 24, Township 14 North, Range 3 East, more particularly described as follows: Beginning at the Southwest corner of the Northwest Quarter of said Section 24; thence running East 343 feet; thence North 200 feet; thence West 343 feet; thence South 200 feet to the point of beginning.
TRACT 6: Beginning at the Northwest corner of the Southeast Quarter of the Southwest Quarter of Section 7, Township 14 North, Range 4 East; thence South 0°53’ West 533.4 feet to the point of beginning proper; thence continue South 0°53’ West 124.3 feet; thence West along the South line of Lots 1, 2 and 3 in Block “A” of Northgate Addition to the City of Jonesboro, Arkansas, 191.1 feet; thence North along the West line of Lot 3 of Block “A” of Northgate Addition to the City of Jonesboro, Arkansas, 137.7 feet; thence East along the North line of Lots 1, 2 and 3 in Block “A” of Northgate Addition to the City of Jonesboro, Arkansas, 194.8 feet to the point of beginning proper, which property is also described as Lots 1. 2 and 3 in Block “A” of Northgate Addition to the City of Jonesboro, Arkansas, as shown by a Plat of record, Deed Record 179, Page 73.
TRACT 7: Begin at the Southeast corner of the Northwest Quarter of the Northeast Quarter of Section 32, Township 14 North, Range 4 East; thence South 89°58’ East on the 40 acre line 170 feet; thence North 0°51’ East 333.4 feet to the centerline of a sanitary sewer; thence North 89°54’ West on centerline of said sewer 271.5 feet; thence North 89°24’ West on centerline of said sewer 342.2 feet; thence North 1°02’ East 122.3 feet; thence West 60 feet; thence South 1°02’ West 121.7 feet to centerline of aforesaid sewer; thence North 89°24’ West on centerline of said sewer 96.7 feet; thence North 89°26’ West on centerline of said sewer 38.4 feet; thence South 1°02’ West 428.8 feet; thence South 69°51’ East 45.0 feet; thence South 83°12’ East 295.3 feet; thence South 78°15’ East 200.0 feet; thence North 66°58’ East 117.0’; thence North 1°05’ East 134.0 feet to the point of beginning proper, containing 8.419 acres, more or less.
TRACT 8: A part of the Southwest Quarter of the Southeast Quarter of Section 28, Township 14 North, Range 4 East, being more particularly described as follows; Begin at the Northeast corner of said Southwest Quarter of the Southeast Quarter; thence South 0° 40’ West 80 feet; thence South 89°57’ West 40 feet; thence North 0°40’ East 80 feet; thence North 89°57’ East 40 feet to the point of beginning, containing 0.073 acre.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to the Wards set out below opposite the tract numbers:

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned in accord with the zoning set out below opposite the tract numbers:

TRACT 4 Commercial (C-2)
TRACT 5 Residential (R-2)

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
