AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-3); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-99:1260 ON JUNE 21, 1999)

WHEREAS, a petition for annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on March 12, 1997; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 16, 1997, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated April 16, 1997, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of May 19, 1997.
NOW, THEREFORE, BE IT ORDAINED AN ENACTED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of April 16, 1997, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
A parcel of land lying in a portion of Section 35, Township 15 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows: The Southwest Quarter of the Northeast Quarter of Section 35, Township 15 North, Range 4 East, less and except the North 176.6 feet of the East 180 feet thereof, together with a part of the East Half of the Northeast Quarter of Section 35, Township 15 North, Range 4 East, more particularly described as commencing at the Southeast corner of said East Half of the Northeast Quarter and run North 0o02' West 628.2 feet; thence South 88o47' West 721.2 feet to the point of beginning proper; thence North 1o27' East 490.6 feet; thence North 2o03' East 127.0 feet; thence North 72o43' West 267.6 feet; thence South 4o15' West 195.6 feet; thence North 87o32' West 337.1 feet; thence South along a fence line 528.8 feet to a East-West fence; thence Easterly 589.3 feet to the point of beginning proper; together with the West 30 feet of the East 210 feet of the Northwest Quarter of the Northeast Quarter of Section 35, Township 15 North, Range 4 East, lying South of the centerline of a public road; the Northwest Quarter of the Southeast Quarter of Section 35, Township 15 North, Range 4 East, containing in all 3,784,383 square feet, 86.877 acres, more or less, subject to easements, restrictions, reservations and rights of way of record.
SECTION 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.
SECTION 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-3).
SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
