A ORDINANCE TO REZONE PART OF THE SOUTHEAST QUARTER AND THE NORTHEAST QUARTER OF SECTION 5, TOWNSHIP 13 NORTH, RANGE 4 EAST

WHEREAS, it is in the best interest of the owner of the property, the residents of the City of Jonesboro and all interested parties that the property described below be rezoned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas:
SECTION 1: The City of Jonesboro, Arkansas. hereby rezones the following described real property situated in Jonesboro, Craighead County, Arkansas, and more particularly described as follows: (Kent Arnold)
A part of the Southeast Quarter and the Northeast Quarter of Section 5, Township 13 North, Range 4 Ease, Craighead County, Arkansas, to wit: BEGIN at the Northeast corner of the Southeast Quarter of said Section 5, then run South 591.3 feet; then run South 88° 19'23" West 1189.9 feet; then run South 00°08'51" East 369.40 feet; then run South 88°31'26"West 614.10 feet; then run North 00°57'24" West 209.02 feet; then run South 87°55'17" West 436.40 feet to the East right-of-way line of Ark. State Highway No. 1-B; then run along said Highway right-of-way line as follows: North 08°16' West 181.44feet, North 08°35' West 40 feet, South 81°25' West 10 feet; North 08°35' West 263.7 feet to a point of curvature, then along a curve to the right, radius of 163.45 feet, through a central angle 09° 36', a distance of 329.0 feet, then run South 88°55' East 10 feet to a point of curvature, then along a curve to the right, radius of 1953.45 feet, through a central angle of 03°28' a distance of 118.1 feet, then run North 04°29' East 93.6 feet; then leaving said East Highway right-of-way line run North 88°22'54" East716.20 feet; then run North 00°56'52" West 269.2 feet; then run North 88°15' 28" East 415.50 feet; then run South 00.25' 42" East 532.20 feet; then run North 88°30' 54" East 1200.50 feet to the point of beginning, containing 47.97 acres and being subject to easements as shown hereon, LESS AND EXCEPT the right-of-way for Caraway Road, said West right-of-way line being 40 feet West from the Quarter section line.
That said property is rezoned from R-1 to R-3.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the rezoning of the aforementioned real property is necessary to maximize the property’s best use and to conform it to the proper zoning regulations.
SECTION 4: The City Council further finds and declares that an emergency exists and this ordinance is necessary for the preservation of public peace, health and safety and shall take effect and be in full force and effect from and after its passage and approval.
