APPEAL HEARING - 6:50 P.M. - In a letter from Mr. Jim Farmer a request was made for postponement of his Appeal Hearing until March 6, 1995. The Metropolitan Area Planning Commission had denied Mr. Farmer's request for rezoning from Residential One to Commercial Three, and Mr. Farmer wanted more time to prepare his case.

 

APPEAL HEARING - 7:15 P.M. - In a phone conversation with City Clerk, Donna Jackson, on February 1, 1995, at 9:45 a.m. Mrs. Mary Mitchell of 500 Ridge Crest, requested the Appeal Hearing scheduled for 7:15 p.m., be withdrawn from the Council's consideration. Ms. Mitchell stated she had decided to accept the decision of the Metropolitan Area Planning Commission.

 

CITY COUNCIL MINUTES, FEBRUARY 6, 1995

 

The Jonesboro City Council met in regular session, Monday, February 6, 1995, at 7:30 P.M. A full quorum was in attendance. Present were the Mayor, City Clerk, City Attorney, and all twelve council members.

 

The minutes of January 16, 1995, were approved as mailed on motion by Councilman Vance seconded by Councilman Wise. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Mayor Brodell read a proclamation declaring March 20, 1995, the "Day of the Arts". The Mayor's proclamation recognized the Museum Advisory Council and fifteen community leaders for planning and organizing the ASU Museum's theme of 1995, Collecting Original Art.

 

Mayor Brodell presented Certificates of Appreciation to Brian Nolan and Sue Cooper for organizing Jonesboro's first Christmas lighting project, "Lights On the Ridge". On behalf of the Jonesboro community, special appreciation was expressed to both Mr. Nolan and Ms. Cooper for making Jonesboro's holiday season so special.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Phillips Investments)

 

Councilman Vance moved, seconded by Councilman Perrin for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2603.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (James McDaniel)

 

Councilman Evans moved, seconded by Councilman Young for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2604.

 

Councilman Kelton offered the following ordinance for the first reading:

Councilman Evans moved, seconded by Councilman Wise to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE 2547, TITLE 2.20, SECTION 2.20.1 FOR THE PURPOSE OF SETTING A DEADLINE ON ALL ITEMS BROUGHT BEFORE THE CITY COUNCIL

 

Councilman Hannah moved, seconded by Councilman Harpole to suspend the rules and place on second reading. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. Councilman Vance moved seconded by Councilman Perrin to further suspend the rules for a third and final reading. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. Councilman Evans moved, seconded by Councilman Tate for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2605.

 

Councilman Harpole moved, seconded by Councilman Perrin for the adoption of a traffic resolution, placing a "YIELD" sign at B. P. Way on the east bound segment into the Trail Mobile Plant, located in the Industrial Park. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:02.

 

Councilman Evans offered a resolution expressing the willingness of the City of Jonesboro to utilize Federal Aid Surface Transportation Program Enhancement Funds for phase one of the Bypass Beautification Project (Commerce Drive to Stadium Boulevard). Mayor Brodell read a letter from the Greater Jonesboro Chamber of Commerce. The letter expressed the Chambers commitment to the following: 1). Secure the necessary 20 % matching funds for completion of the first phase; 2). To organize volunteers to plant the trees; and to maintain the plantings including watering the first year or so, and possible replacement of trees. Councilman Hannah moved, seconded by Councilman Perrin for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:03.

 

Councilman Vance moved, seconded by Councilman Young for the adoption of a resolution expressing the willingness of the City of Jonesboro to enter into a Traffic Control Device Agreement with the Arkansas State Highway and Transportation Department, regarding Highway 49-B and Marshall Street. The Traffic Control Device Agreement states the City of Jonesboro agrees to the following:

 

(1) Provide underground electrical power to the controller(s) for the traffic control device(s) and to maintain the traffic control device(s) being installed by the Arkansas State Highway and Transportation Department at the intersection(s) of Highway 49-B at Marshall Street.

 

(2) Modifications to the traffic control device installation or changes in the controller dial settings, cycle length, and operation of the traffic control device will be made without approval from the Department.

 

(3) The City of Jonesboro will save the Department harmless from any and all damage claims that may arise during the period that the traffic control devices are being maintained by the City.

 

A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:04.

 

Councilman Harpole moved, seconded by Councilman Kelton to reset an Appeal Hearing for March 6, 1995, at 7:10 p.m. as requested by Mr. Jim Farmer. The Appeal Hearing pertains to a rezoning denial by the Metropolitan Area Planning Commission. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Under new business, Mayor Brodell encouraged everyone to go vote for the one cent sales tax, and invited everyone to an election party, February 7, 1995, at 7:00 p.m.

 

Councilman Province inquired about the Dalton Johnson property. Mr. Brian Wadley, Director of Planning and Inspections stated the property was not owned by Mr. Dalton as originally thought, but by a sister to Mr. Dalton. Mr. Wadley stated the house would be torn down this year. Councilman Province also reported he had received numerous calls regarding trash cans being left at the curb. Mayor Brodell instructed Mr. Bill Mueller, Sanitation Superintendent to follow up on these sanitation complaints.

 

Councilman Tate reported he had received a call from Mr. Mike Crews, Coordinator for the Jonesboro Christian Softball Association, requesting the City of Jonesboro to provide the land so they could build a couple of ball fields. Mayor Brodell responded by stating he had made some inquiries, but has not been successful. However, Mayor Brodell stated he would keep working on the situation.

 

Councilman Harpole informed the Council that the Employee Handbook would be given to the Department Heads by the middle of the month (February), and to the Council by March 6, 1995. The Personnel Committee has approved the Employee Handbook and plans to offer it to the full Council by March 20, 1995. Councilman Harpole stated the next project to be addressed by the Personnel Committee is a Salary Administration Plan.

 

Councilman Hannah inquired about the Engineering Software bids which were pulled at the last council meeting. Mr. Hannah suggested the bids be rejected at the next council meeting in an effort to keep the vendors informed of what the Council is doing.

 

Councilman Hannah moved, seconded by Councilman Vance for the adoption of a resolution requesting City Water and Light to provide free underground electrical power to the controller(s) for the traffic control devices and to maintain the traffic control devices being installed by the Arkansas State Highway and Transportation Department at the intersection(s) of Highway 49-B at Marshall Street. A roll call vote was taken resulting in all council members voting aye. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:05.

 

Councilman Vance moved, seconded by Councilman Kelton to accept the Finance Committees recommendation to revise the 1995 budget increasing the base salary of the Work Release Coordinator from $17,231.00 to $18,714.00, a difference of $1,483.00, with the money to come from the Work Release budget. A roll call vote was taken resulting in all council members voting aye, with the exception of Councilman Hannah who voted nay. Those aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, and Harpole.
