AN ORDINANCE TO AMEND SECTION 8.28.12 OF THE JONESBORO CODE OF ORDINANCE USE OF ROADBLOCKS IN SOLICITATION OF GIFTS OR CONTRIBUTIONS

WHEREAS, it is the desire of the City of Jonesboro to regulate solicitation of gifts and donations, and contributions at intersections and upon roadways lying within the city limits of Jonesboro, and
WHEREAS, there being a need to restrict or prohibit entry into the roadway of said streets and intersections to provide for the safety of the solicitors as well as of to prevent the impede of traffic flow in said roadways,
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, that:
SECTION 1: That previous Ordinance Sec. 8.28.12 shall be amended to include the following sentence:
(A) That it shall be unlawful for any person from any organization, club or corporation to solicit and/or collect gifts, donations or contributions of money or goods of any kind for any purpose whereby roadblocks of traffic are utilized.
(B) That it shall be further prohibited and shall constitute a violation of this ordinance for any person, organization, firm, club or corporation to enter into or upon said roadway or intersection for the purpose of soliciting and/or collecting gifts, donations or contributions of goods or monies of any kind for any purpose.
(C) For purpose of this ordinance entry into or upon the roadway or intersection shall include specifically the travelled portion of said roadway or intersection together with the adjacent right of way.
(D) That any violation of this city ordinance shall be termed a violation in keeping with the provision of Ark. Code Annot Sec.5-1-105 and shall be punishable by a fine of $50.00.
(E) That any ordinance or any parts of ordinances in direct conflict herewith are hereby repealed.
(F) That there being an immediate need due to preservation of the health, safety and welfare of the citizens of Jonesboro an emergency is hereby declared to exist and this ordinance shall hereby take effect from and after its passage and approval.
