Minutes for the City Council meeting on February 5, 1996

PUBLIC HEARING - 6:20 p.m. - A public hearing was held as requested by the Jonesboro Industrial Corp. for the purpose of vacating a drainage easement located east of Quality Way, one-half mile south of Highland Drive. No opposition was voiced.

 

CITY COUNCIL MINUTES, FEBRUARY 5, 1996

 

The Jonesboro City Council met Monday, February 5, 1996, at 6:30 p.m. A full quorum was in attendance. Present were: Hubert Brodell, Mayor, Donna Jackson, City Clerk; Phillip Crego, City Attorney, and 12 council members. Those members were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah.

 

The minutes of January 15, 1996, were approved as mailed by Councilman Perrin seconded by Councilman Tate. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Council tabled a decision on the Gary Winters appeal regarding the M.A.PC.’s granting a “Special Use Permit” to Dr. Jack Jones. The Council also tabled agenda item A, the Betty Waddle appeal for rezoning, which had been amended from Commercial Three to Commercial Four. City Attorney, Phillip Crego ruled the ordinance would not have to begin with a first reading, but could be amended and read the third and final time. Both items were tabled at the request of Attorney Charles Mooney, Sr.

 

The following ordinance was up for second reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. ( Dianne Duschl\ C.S. Mooney, Sr.)                     

 

No further action was taken regarding this ordinance.

 

The following ordinance had been read twice then amended from Commercial One to Commercial Three. City Attorney, Phillip Crego ruled the ordinance could be amended and read a third time.

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Doyle Yarbrough)

 

Councilman Vance moved, seconded by Councilman Harpole to amend the ordinance from Commercial One to Commercial Three. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was given the number 2677.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO VACATE AND ABANDON A 50' DRAINAGE EASEMENT LOCATED 2 MILE SOUTH OF HIGHLAND DRIVE, EAST OF QUALITY WAY.

(Jonesboro Industrial Development Corp.)

 

Councilman Vance moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Vance moved, seconded by Councilman Tate to further suspend the rules and place on the third and final reading. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Tate moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was given the number 2678.

 

The following ordinance was up for third reading:

 

AN ORDINANCE ESTABLISHING THE SOUTHVIEW ACRES STREET IMPROVEMENT DISTRICT NO. 1

 

Councilman Tate moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was given the number 2676.

 

The following ordinance was up for the third and final reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES ( Farmer Enterprises)

 

Councilman Vance objected to the M.A. P.C.’s recommendation of an Industrial (I-1) zoning for the Farmer Enterprises property, stating it should be zoned Industrial (I-2) a more restrictive zoning, noting the property serves as a gateway to the city. Mr. Alec Farmer stated he had researched the matter with Brian Wadley, of the Planning and Inspection Department, and it was determined by Jonesboro’s definition of Industrial Zoning the (I-1) zoning was necessary for Farmer Enterprises, Inc to conduct any type of manufacturing business. Mr. Farmer also reminded Council the Metropolitan Area Planning Commission had approved the Industrial (I-1) zoning. Councilman Young asked if Mr. Farmer would mind tabling the ordinance till the next meeting, so council members could research the definitions in Industrial One and Industrial Two zoning. Mr. Farmer was reluctant but did agree to table his ordinance for two weeks. Councilman Perrin moved, seconded by Councilman Young to table the ordinance for two weeks. A voice vote was taken, resulting in all council members voting aye, with the exception of Councilman Harpole who voted nay. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, and Hannah.

 

The following ordinance was on the third and final reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Brown Lacy)

 

Councilman Harpole moved, seconded by Councilman Province for the adoption of the ordinance. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was given the number 2679

 

Councilman Tate offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Ruth Steinsiek - R-1 to C-4)

 

Councilman Tate moved seconded by Councilman Young to suspend the rules and place on the third and final reading: A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was read a second time.

 

Councilman Young offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Ruth Steinsiek - R-1 to C-3)

 

Councilman Tate moved seconded by Councilman Young to suspend the rules and place on the third and final reading: A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was read a second time.

 

Councilman Harpole moved seconded by Councilman Tate for the adoption of a resolution to set a public hearing for 6:20 p.m., February 19, 1996, prior to the next council meeting. The purpose of the hearing is to vacate a five foot utility easement, located along the north side of Lot 18, Block A of Bellaire 3rd Addition, requested by John P. Black, Audrey M. Black, and their attorney, Mr. Charles Mooney, Sr. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The resolution was given the number 1996:05.

 

Councilman Evans moved, seconded by Councilman Perrin for the adoption of a traffic resolution placing stop signs at the following locations:

 

 - On Vail Dr. at Bob White Dr.

 - On Bob White Dr. at Turtle Creek Rd.

 - On Pebble Creek Cove at Pebble Creek Place

 - On Tower Wood Lane at Tower Park Drive

 - On Tower Park Drive at Neeley Road

 - On Doral Dr. at Lacoste Drive

 - On Doral Cove at Doral Doral Drive

 - Spyglass Drive at Hazeltine Drive

 - Hazeltine Drive at Lacoste Drive

 - Lactose Cove at Lacoste Drive

 - On Kersey Lane at Valley View Drive

 - On Valley Ridge Trail at Valley View Drive

 

A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The resolution was given the number 1996:04.

 

Councilman Vance moved, seconded by Councilman Harpole for the adoption of a resolution to condemn property located at 2107 Maurice Street, Bonnie Wynne of Jonesboro being the owner. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The resolution was given the number 1996:03.

 

Councilman Harpole moved, seconded by Councilman Young to approve the appointment of Curtis Tate to the Parks and Recreation Commission. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Councilman Harpole moved, seconded by Councilman Perrin to approve the reappointment of Sandra Burns and Herbert Parker to the Library Board. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Under new business Councilman Perrin offered the following ordinance:

 

AN ORDINANCE TO APPROPRIATE MONEY FROM UNALLOCATED SALES TAX FOR THE PURCHASE OF A PARCEL OF LAND FROM THE DENA CONSTRUCTION COMPANY ($550,000.00 for new park area)

 

Councilman Young moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Evans moved, seconded by Councilman Young to further suspend the rules and place on the third and final reading. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Rega moved, seconded by Councilman Harpole for the adoption of the ordinance. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah. The ordinance was given the number 2680.

 

Councilman Perrin moved, seconded by Councilman Young to authorize Stephens, Inc., the bond underwriters for Jonesboro’s MATA project, to begin issuing the first series of bonds around May 1, 1996. A voice vote was taken, resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole, and Hannah.

 

With no further business the meeting was adjourned.
