AN ORDINANCE IMPOSING AN AGE LIMITATION ON CERTAIN CLASSIFICATIONS OF MOTION PICTURES; AND FOR OTHER PURPOSES

THAT WHEREAS, a committee was duly appointed by the Churchmen's Club of Jonesboro to make recommendations to the Jonesboro City Council, and that
 
WHEREAS, the committee has recommended that persons under the age of eighteen years be prohibited from viewing motion pictures with the rating of "R" or "X", and that
 
WHEREAS, said recommendation appears to be in the best interest of the City of Jonesboro, Arkansas.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
Section 1: That from and after the effective date of this ordinance any person who shall knowingly admit any male or female child under the age of eighteen years to any motion picture which shall have been classified by the motion picture industry as an "R" or "X" movie shall be guilty of a misdemeanor, and upon conviction shall be fined in a sum of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) and that each such knowing admission shall constitute a separate offense.
 
Section 2: That it shall be the duty of any person, firm or corporation who owns or operates a motion picture theater within the corporate limits of the City of Jonesboro. Arkansas, to ascertain the legal age of all male and female children which shall present themselves for admission to a movie with the classification of "R" or "X". Presentation of fictitious identification by the male or female child shall not constitute a defense to Section 1 hereof, but shall be taken to mitigation thereof by a court of competent jurisdiction.
 
Section 3: That all persons, firms or corporations who own or operate motion picture theatres within the corporate limits of the City of Jonesboro, Arkansas shall forthwith display prominently and legible in all newspaper advertisements and on their theatre marques and ticket window the motion picture industry rating for the film which is being currently shown. No advertisement, trailer or preview of an "R" or "X" rated movie. Any person, firm or corporation who shall willfully violate the provisions of this section shall be guilty of a misdemeanor and upon conviction shall be fined in a sum of not less than Fifty ($50.00) Dollars nor more than One Hundred ($100.00) Dollars.
 
Section 4: That if any section of this ordinance shall be ruled to be unconstitutional, it shall not affect the validity of the remaining sections herein.
 
Section 5: That because of the urgent necessity to criminal sanctions to the motion picture classifications, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after the date of its passage and approval.
