BE IT ORDAINED by the City Council of Jonesboro, Arkansas:   

 

SECTION 1: Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classification as follows:

 

From Commercial (C-3) to Industrial (I-1) the following described property:

 

LEGAL DESCRIPTION:

 

A part of the Northeast Quarter (NE3) of Section 35, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:

 

From the Southeast corner of the Southeast corner of the Southeast Quarter of the Northeast Quarter (SE 3, NE 3) of said Section 35, thence S89°39'04" W. 141.88 feet along the South line of the Southeast Quarter of the Northeast Quarter of said Section 35 to a Point of the Westerly right of way of U. S. Highway 63, the Point of Beginning

 

Continue thence S89°39'04" W. 482.46 Feet along said South line to a Point on the Easterly Right of Way of the Burlington Northern Railroad, Thence along said railroad Right of Way N43°37'30"W 988.01 feet to a point on the East line of the Southwest Quarter of the Northeast Quarter of said Section 35, continue thence N43°37'30"W. 820.92 feet along said Right of Way to a point on the North line of the Southwest Quarter of the Northeast Quarter of said Section 35, thence N89°45'11" E. 578.65 feet along said North line to the Northwest corner of the Southeast Quarter of the Northeast Quarter of said Section 35, Thence N89°45'10" E. 352.58 feet along the North line of the Southeast Quarter of the Northeast Quarter of said Section 35 to a Point on the westerly Right of Way of U.S. Highway 63, continue thence N89°45'10"E 138.80 feet along said Right of Way along the North line of the Southeast Quarter of the Northeast Quarter of said Section 35 to a point, Thence S32°14'08"E 330.74 feet along said Right of Way to a point, thence S19°57'44"E 886.98 feet along said Right of Way to a point, Thence S34°09'33"E 186.82 feet along said Right of Way to the Point of Beginning, containing 3.963 acres in the Southwest Quarter of the Northeast Quarter of the Northeast Quarter of said Section 35, and some 18.872 acres in the Southeast Quarter of the Northeast Quarter of said Section 35 for a total acreage of some 22.835 acres, more or less.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract of land described in this Ordinance is being delayed because of improper zoning, and that, therefore, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
