CITY COUNCIL MINUTES - JUNE 16, 2003

 

The Jonesboro City Council met Monday, June 16, 2003, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk, Donna K. Jackson, and ten council members. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy. Councilman Perrin and Councilwoman Williams were unable to attend. City Attorney Crego arrived late to the meeting due to night court.

 

Councilman Moore moved, seconded by Councilman Street to approve the minutes of June 2, 2003, as previously delivered. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy.

 

Councilman Moore moved, seconded by Councilman Street to table Item 5A, an ordinance making it necessary for surveyors to submit surveys in a digital format. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO ADOPT BY REFERENCE THE 2002 EDITION OF THE ARKANSAS FIRE CODE INCLUDING THE BUILDING CODE

 

Councilman Moore moved, seconded by Councilman Street for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy. The ordinance was assigned ordinance number 3416.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL R-1 AND COMMERCIAL C-3 TO COMMERCIAL C-3 LIMITED USE OVERLAY LOCATED ON THE NORTHWEST CORNER OF HIGHLAND DRIVE AND WOFFORD STREET (INHOC, LLC)

 

Councilman Young moved, seconded by Councilman Roddy for the adoption of the ordinance. A roll call vote was taken resulting and eight to two vote in favor of the motion. Those members voting aye were: Farmer, Hargis, Street, Young, Dover, Copeland, McCall, and Roddy. Those members voting nay were: Province and Moore. The ordinance was assigned ordinance number 3417.

 

Councilman Roddy offered the following ordinance for first reading:

 

AN ORDINANCE AMENDING THE JONESBORO CODE OF ORDINANCES, CHAPTER 5.16 KNOWN AS GARBAGE, TRASH, AND WEEDS TO INCLUDE SECTION 5.16.25 ENTITLED REMOVAL OF BULKY WASTE; ESTABLISHING FINES AND FEES AND FOR OTHER PURPOSES.

 

Sanitation Committee Chair, Bill Roddy recommended a public hearing for the purpose of discussing the ordinance. Councilman Farmer recommended the ordinance be reviewed by City Attorney, Crego for proper form. No further action was taken.

 

Councilman Hargis moved, seconded by Councilman Young to approve a Conditional Use Permit for The Merritt Group, contingent on approval by City Planner, Glenn Batten. Questions were raised as to the City Planner providing a recommendation since a decision was delayed at the last council meeting due to an incomplete application. A voice vote was taken resulting in all members voting aye with the exception of Councilman Moore who voted nay. Those members voting aye were: A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Street, Young, Dover, Copeland, McCall, and Roddy.

 

Councilman Young moved, seconded by Councilman Dover authorizing the mayor and city clerk to execute and accept the Contract for preparation of Municipal Code by the Arkansas Municipal League. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy. The resolution was assigned number 2003:35.

 

Councilman Moore moved, seconded by Councilman Street to table a resolution changing the name of “Cottage Home Road” to “Nestle Way” within the Jonesboro city limits. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy.

 

Councilman Young moved, seconded by Councilman Moore for the adoption of a resolution setting a public hearing for the purpose of abandoning four (4) dedicated utility easements located in the First Replat of the West Branch Commercial Addition as requested by Wal-Mart Stores, Inc. The hearing was set for July 7, 2003, at 6:15 p.m. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy. The resolution was assigned number 2003:36.

 

Under new business by the Mayor, the council was informed of a request for a Conditional Use Permit by Mr. John Deluca. Mayor Brodell explained Mr. Deluca had missed the deadline to file an appeal regarding the MAPC decision. No action was taken. Mayor Brodell also explained Mr. Steve Martin had extended the time for the landfill to mid July so additional comments could be responded to by the ADEQ. Councilman Dover questioned the status of the existing landfill. Mayor Brodell stated the landfill passed its last inspection and is in use at the present time. He explained they were trying to get an extension until the new landfill could be obtained. Councilman Dover questioned what the plan was, if the city is forbidden to use the landfill. Mayor Brodell stated he was meeting with Attorney Ralph Ohm to discuss the matter on Wednesday morning.

 

Councilman Farmer moved, seconded by Councilman Moore to approve reimbursement for council members attending the Arkansas Municipal League meeting. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy.

 

Councilman Farmer announced the Finance and Administration Committee would meet June 24th, and explained one issue to be discussed would be the procedure of referring budget amendments, by other committees, to the Finance & Administration Committee prior to it being brought to the full council.

 

Councilman Farmer referred to an article in the Jonesboro Sun that indicated the Jonesboro City Council would consider an ordinance pertaining to asphalt at tonight’s meeting. He explained the Infrastructure Committee had requested the parties involved meet with the City Attorney and Public Works Director prior to bringing the matter before the proper committees for recommendation to the full council.

 

Councilman Moore questioned the status of the sound system. Mayor Brodell stated he did not know the status of the work. It was explained by Councilman Copeland that Ms. Suzanne Hackney, Human Resource Director was choosing the fabric for the acoustical panels.

 

City Attorney Phillip Crego provided his monthly legal report, saying in the case of City Water and Light and the City of Jonesboro Vs. Norsworthy the judge ruled in the City’s favor. He explained an appeal could be filed in the next thirty days.

 

With no further business, Councilman Farmer moved, seconded by Councilman Moore for adjournment. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Moore, Street, Young, Dover, Copeland, McCall, and Roddy.
