AN ORDINANCE TO VACATE AND ABANDON A CERTAIN PORTION OF CHESTNUT STREET IN THE CITY OF JONESBORO, ARKANSAS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 1st day of October, 1958, asking the City Council to vacate and abandon all that portion of the street designated on the plat of Nesbitt's Second Addition to the City of Jonesboro, now appearing of record in Deed Record 20, page 619 in the office of the Recorder of Craighead County, Arkansas, and more particularly described as follows, to-wit:
A part of Chestnut Street lying between Block 8 and the East 194 feet of Block 9 of Nesbitt's Second Addition to Jonesboro, Arkansas, and more particularly described as follows: Beginning at the Northwest Corner of Block 8 on Nesbitt's Second Addition to the City of Jonesboro, Arkansas thence in a Westerly direction approximately 50 feet to the Northeast Corner of Block 9 of Nesbitt's Second Addition to the City of Jonesboro, Arkansas; thence South along the East line of Block 9 approximately 220 feet to the Southeast Corner of Block 9; thence east approximately 50 feet to the Southwest Corner of Block 8; thence North along the West line of Block 8 approximately 220 feet to the point of beginning proper.
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question, and has ascertained that the street or portion thereof herein before described has heretofore been dedicated to the public use as a public street as herein described; that the Jonesboro Special School District is an educational institution and owns all of the abutting property, and that public interest and welfare will not be adversely affected by the abandonment of such street.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to that portion of Chestnut Street more particularly described above.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the County and recorded in the deed records of the County.
SECTION 3: This ordinance shall take effects and be in force from and after its passage.
