AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED SEPTEMBER 11, 1978; PROVIDING FOR A ZONING CLASSIFICATION FOR SAID LANDS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed with the Clerk of the County Court of Craighead County, Arkansas, at Jonesboro, Arkansas, on the 27th day of July, 1978; and
WHEREAS, said petition for the annexation of said lands was signed by the owner of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing on said petition was entered, notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court on the 11th day of September, 1978, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon, an order of annexation was made and entered; and
WHEREAS, 30 days have expired since the order of annexation dated September 11, 1978, was entered and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas;
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court for the Jonesboro, Arkansas, be order of the County Court for the Jonesboro District of Craighead County, Arkansas, dated September 11, 1978, be, and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereafter be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
A part of the NE ¼ of the NW ¼ of Section 15, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Southwest Corner of the NE ¼, NW ¼ of Section 15 aforesaid; thence North along the 40 acre line 650.0’; thence N 89°11’ E 469.16’; thence South 650.0’ to the South line of said NE ¼ NW ¼: thence S 89° 11’E 469.16’; along the 40 acre line to the point of beginning containing 7.00 acres.
Section 3: The zoning classification of the lands to be annexed shall be R-1.
Section 4: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are signed and attached to Ward 3.
