AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED FEBRUARY 14, 1975, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4 DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described as duly filed with the County Clerk of Craighead County, Arkansas, Western District on February 14, 1975; and
WHEREAS, said petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said petition was entered, and notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court on the 14th day of February, 1975, at 9:30 a.m., at which hearing it was duly found and declared by the court that said petition for annexation was right and proper, and that said lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexation dated February 14, 1975, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: That territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated February 14, 1975, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants within the new annexation shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
Commencing at the North ¼ corner of Section 31, Township 14 North, Range 4 East; thence N 89 degrees 25’ E along the section line 132.0’ thence S 0 degrees 54’ E 1313.7’; thence S 89 degrees 24’ W 400’; thence N 0 degrees 54’ W 1313.8’ to the Section line; thence N 89 degrees 25’ E along the section line 268.0’ to the point of beginning, containing 12.06 acres subject to a public road R/W off the North side thereof. A part of the Northwest Quarter of the Northwest Quarter of section 31, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Northwest Corner of the Northwest Quarter of the Northwest Quarter of said Section 31, said corner being a point on the existing centerline of Parker Road; thence South 89 Degrees 39 Minutes East along said centerline 245.0 feet to a point in the Existing centerline of Parker Road; thence South 01 Degree 08 Minutes West 109.8 feet to South permanent easement line of existing Parker Road, the point of beginning proper; thence South 42 Degrees 19 Minutes 31 Seconds West along said Parker Road Easement line 191.8 feet to the Easterly edge of existing right-of-way of South Culberhouse Road; thence East 130 feet to the Southwest Corner of Roy E. Holt property; thence North along said Holt property 130.2 feet to the point of beginning proper, containing 0.13 acre, more or less, A part of the Northwest Quarter of the Northwest Quarter of Section 31, Township 14 North, Range 4 East, more particularly described as follows: Commence at a point which is 30 feet South and 840 feet West of the Northeast Corner of the Northwest Quarter of the Northwest Quarter of said Section 31; thence West 115 feet; thence South 210 feet; thence East 115 feet; thence North 210 feet to the point of beginning proper.
Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City and assigned and attached to Ward 4.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water, and other protection and benefits in order to allow the orderly growth and development of said lands and territory, and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
