AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED JUNE 25, 1975; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on May 23, 1975; and

 

WHEREAS, said petition for the annexation of said land was signed by the sole owner of all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on June 25, 1975, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty (30) days have expired since the order of annexation dated June 25, 1975, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of July 28, 1975.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of June 25, 1975, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:

 

A part of the Northwest Quarter of the Northwest Quarter (4.00 acres) and a part of the Northeast Quarter of the Northwest Quarter (1.013 acres) all being in Section 25, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Southeast corner of the Northwest Quarter of the Northwest Quarter, Section 25 aforesaid; thence North 1 degree 52 minutes East 103.9 feet along the East line of the aforesaid Northwest Quarter of the Northwest Quarter, to the point of beginning proper; thence North 27 degrees 49 minutes West 124.9 feet to the center of an existing sanitary sewer manhole; thence South 65 degrees 21 minutes West, along the route of an existing sanitary sewer, 146.0 feet; thence North 24 degrees 48 minutes 45 seconds West 489.9 feet to the South right of way line of Wood Springs Road; thence along said right of way as follows: in a Northeasterly direction along the arc of a 13.428 degree curve to the left 18.1 feet, thence North 41 degrees 07 minutes 30 seconds East 300.0 feet, thence in a Northeasterly direction along the arc of a 21.222 degree curve to the right 89.5 feet, thence North 60 degrees 06 minutes 30 seconds East 92.84 feet, thence in a Northeasterly direction along the arc of a 19.864 degree curve to the right 81.2 feet to a point on the West bank of Christian Creek on the South right of way line of Wood Springs Road; thence along said West bank of Christian Creek as follows: South 51 degrees 37 minutes West 13.7 feet; thence South 59 degrees 06 minutes West 57.5 feet; thence South 12 degrees 10 minutes West 61.4 feet to a point on the East bank of Christian Creek; thence along the East bank of Christian Creek as follows: South 25 degrees 14 minutes West 37.0 feet, thence South 17 degrees 49 minutes West 24.6 feet, thence South 19 degrees 29 minutes East 39.5 feet, thence South 4 degrees 13 minutes East 83.3 feet, thence South 5 degrees 44 minutes East 90.7 feet to a point on the West bank of Christian Creek; thence along the West bank of Christian Creek as follows: South 26 degrees 32 minutes East 89.1 feet, thence South 79 degrees 39 minutes 30 seconds East 102.2 feet, thence South 58 degrees 12 minutes East 87.5 feet, thence South 28 degrees 35 minutes West 28.2 feet, thence North 83 degrees 47 minutes 30 seconds West 66.5 feet, thence South 20 degrees 53 minutes 30 seconds West 65.6 feet, thence South 27 degrees 11 minutes 30 seconds East 84.2 feet, thence South 75 degrees 16 minutes 30 seconds West 109.7 feet, thence South 4 degrees 57 minutes East 87.8 feet, thence North 87 degrees 11 minutes West 64.9 feet to the point of beginning proper and containing in all, 5.013 acres, more or less, and being subject to an easement for a sanitary sewer as noted on the plat.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.

 

Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow growth and development of said lands and territory.  Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety, shall take effect and be in full force from and after its passage.
