METROPOLITAN AREA PLANNING COMMISSION

FEBRUARY 14, 1995

 

MEMBERS PRESENT: Coleman, Little, Damron, McCracken, Finley, Beadles, Shaw and Phillips

 

MEMBERS ABSENT: Pitts

 

Minutes of the January 10, 1995, meeting were approved as submitted.

 

#1 RZ95-5 Dallas, Timmy and Regina Spence requested approval of rezoning from R-1 to C-3 for 9.74 acres located on the west side of Stadium Boulevard, south of Fox Road.

 

Ms. Shaw moved to approve the request as submitted, seconded by Mr. Little. Five voted aye, 0 no, 2 absent for this vote. REQUEST APPROVED.

 

#2 MP95-13 Dallas Spence requested approval of a one lot minor plat containing 3.24 acres. The property is located on the west side of Stadium Blvd., south of Fox Road.

 

Mr. Phillips moved to approve the request subject to a 60’ right of way for Malibu Drive to extend to south property line to align with existing street. Dr. Beadles seconded the motion, 6 voted aye, 0 no, one absent for this vote. REQUEST APPROVED WITH STIPULATION.

 

#3 SP95-3 Dallas Spence requested approval of site plans for a commercial center to be located on the west side of Stadium Blvd, south of Fox Road.

 

Dr. Beadles moved to approve the request subject to the site plan being redrawn to show the street right of way for Malibu and the building conforming with applicable codes. Ms. Shaw seconded with 6 voting aye, 0 no, one absent for vote, REUQEST APPROVED WITH STIPULATION.

 

#4 RZ95-6 Stephen Stoker requested approval of rezoning from R-1 to C-3 for .041 acres located on the west side of Stadium Boulevard, north of Harrisburg Road.

 

Ms. Shaw moved to approved the request, seconded by Mr. Damron, 6 voted aye, 0 no, one absent for vote. REQUEST APPROVED.

 

#5 RZ95-7 Farmer Enterprises, Inc., requested approval of rezoning from C-3 to I-1 for 3.66 acres located on the west side of Commerce Drive, approximately ¼ mile south of C.W. Post Road.

 

Ms. Shaw moved to approve the request, seconded by Mr. Little. Six voted aye, 0 no, one absent for vote. REQUEST APPROVED.

 

#6 RP95-2 Bill Dacus, Dacus Fence Company, requested approval of a replat of part of Lot 1 of Chapmen & Dewey Lumber Company Addition. The property is located on the southwest corner of Johnson Avenue and Culberhouse Street.

 

Dr. Beadles moved to approve subject to the property owner following the MATA plan for street right of way. It was noted that this is a major intersection in Jonesboro and carries lots of heavy truck traffic and major improvements are going to have to be made for the street to function properly. The development of this property will further compound the existing traffic problem. Ms. Shaw seconded with 7 voting aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#7 MP95-9 Dale Barnett requested approval of a three lot plat containing 10.72 acres. The property is located on the south side of Peachtree Avenue, west of Bridger Road.

 

It was noted that one of the three lots has not street access and one has questionable access. After discussion with the property owner, a suggestion was made that he have the plat redrawn as two lots, combining the lot without street access with one of the others.

 

Mr. Little moved to approve the request with a revised drawing, showing two lots or having proper street access for Lot 3. Ms. Shaw seconded with 7 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#8 RZ95-8 David Clines requested approval of rezoning from R-1 to C-3 for 3.03 acres located on the west side of Stadium Boulevard, south of the Southside Softball Complex.

 

Mr. McCracken moved to approve subject to a five foot utility easement adjacent to the right of way. Ms. Shaw seconded with 7 voting aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#9 RZ95-9 Kent Arnold requested approval of rezoning from R-1 to C-3 for 3.32 acres and from R-1 to R-3 for 26.73 acres located on the west side of Stadium Boulevard, east of Caraway Road and north of Harrisburg Road.

 

Mr. Arnold was given a caution about development plans that might be brought in the future. The commissioners expressed concerns about density, access to Caraway Road and separation of the two tracts. Opposition to the R-3 request was presented by several area residents. There was some discussion about the use of the 100’ frontage on Caraway Road and any conflicts with the existing power line crossing the property. Development plans will be required prior to building on the property.

 

Mr. McCracken moved to approve the request subject to:

 

1.                     50’ right of way on Caraway Road

2.                     Subject to right of way on Harrisburg Road being shown in compliance with the Master Street Plan

3.                     Subject to the 5’ utility easement on Stadium

4.                     Subject to the duly noted concerns questioning density and access to the subject property

Mr. Phillips seconded with 6 voting aye, 1 no, REQUEST APPROVED WITH STIPULATIONS.

 

#10 RZ95-10 Kent Arnold requested approval of rezoning from R-1 to C-3 for 7.93 acres located on the west side of Stadium Boulevard, south of Harrisburg Road.

 

Ms. Finley moved to approve the request subject to a new plat being drawn to show a 5’ easement and the right of way on Stadium being shown. Mr. Little seconded with 7 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#11 PP95-1 Kent Arnold requested approval of Caraway Place Commercial, a subdivision containing 6 lots on 2.4 acres. The property is located on the east side of Caraway Road on the north and south sides of Glenn Place.

 

Item withdrawn by developer.

 

#12 PP95-2 Kent Arnold requested approval of Key Place Commercial, a subdivision containing 11 lots on 7.27 acres. The property is located on the south side of Johnson Avenue, on the east and west sides of Murray Creek Drive.

 

It was noted in discussion that this property, when rezoned by the City Council, had a stipulation that would allow only a total of three accesses to Johnson Avenue with Murray Creek Drive being one of them.

 

Mr. McCracken moved to give preliminary approval subject to:

 

1.                     Right of way showing 60’ on Johnson

2.                     5’ utility easement on Johnson

3.                     5’ utility easement on Murray Creek Drive, adjacent to right of way and on both sides of the street

4.                     20’ sanitary sewer easement on south side of Lots 3, 5, 6, 7, 8, 9, 10 and 11

5.                     Document to be prepared limiting ingress and egress to the proposed lots fronting Johnson

6.                     Reconsideration of use of Lot 5

Ms. Finley seconded with 7 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.
