AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED JULY 24, 1978; PROVIDING FOR A ZONING CLASSIFICATION FOR SAID LANDS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed with the Clerk of the County Court of Craighead County, Arkansas, at Jonesboro, Arkansas, on the 9th day of June 1978; and,
WHEREAS, said petition for the annexation of said lands was signed by all of the owners of the acreage to be annexed to the City of Jonesboro, Arkansas; and,
WHEREAS, an order setting a hearing on said petition was entered, notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court on the 24th day of July, 1978, at which hearing was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,
WHEREAS, thirty days (30) have expires since the order of annexation dated July 24, 1978, was entered and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas;
NOW, THERFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court for the Jonesboro District of Craighead County, Arkansas, dated July 24, 198, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereafter be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Rankin Addition)
A part of the Southwest Quarter, of the Northwest Quarter (5.34 ac.) of Section 25, a part of the Northwest Quarter of the Southwest Quarter (35.18 ac.) of Section 25, a part of the Northeast Quarter of the Southwest Quarter (7.00 ac.) of Section 25, a part of the Northeast Quarter of Southeast Quarter (11.995 ac.) of Section 26, all being Township 14 North, Range 3 East, Craighead County, Arkansas, more particularly described as follows: Beginning at the Southwest corner of the Southwest Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East; thence North 1°06’ East 660.0 feet; thence along the Southwesterly right-of-way lint of Highway 63 By-Pass as follows: South 47°37’30” East 379.6 feet, South 44°37’ East 492.0 feet, South 49° 54’30” East 320.1 feet, South 52°East 95.9 feet, South 46°50’East 499.5 feet, South 38°16’ East 201.9 feet, South 52°28’30” East 302.0 feet, South 20°01’ East 61.9 feet, South 27°44’30” East 58.8 feet, South 61°39’ East 223.6 feet, South 46°24’30” East 44.3 Feet; thence South 88°43’30” West 231.7 feet; thence South 1°38’ West 150.0 feet; thence South 89°35’ West 466.0 feet; thence South 89°50’ West 761.0 feet; thence North 89°56’ West 252.9 feet; thence South 89°21’30” West 590.7 feet; thence North 1°21’ East 571.7 feet; thence along a curve to the left with a radius of 289.0 feet for a distance of 110.2 feet; thence North 20°27’ West 206.2 feet; thence North 1°06’ East 64.0 feet; thence North 88°54’ West 260.0 feet; thence North 1°06’ East 329.3 feet; thence North 89°40’ East 672.2 feet to the point of beginning proper, containing, in all, 59.454 acres, more or less.
Section 3: The zoning classification of the lands so annexed shall be as follows:
A part of the Northeast Quarter of the Southeast Quarter, of Section 26, Township 14 North, Range 3 East, Craighead County, Arkansas, more particularly described as follows: Beginning at the Southwest Corner of the Southwest Quarter of the Northwest Quarter Section 25, Township 14 North, Range 3 East; thence South 1°06’ West 196.7 feet; thence continue South 1° West 646.9 feet; thence along a curve to the left with a radius of 257.7 feet a distance of 10.87 feet: thence North 88°39’ West 160.0 feet; thence South 1°21’ West 467.6 feet; thence South 89°21’30” West 150.1 feet; thence North 1°21’ East 571.7 feet; thence along a curve to the left with a radius of 289.0 feet a distance of 110.2 feet; thence North 20°27’ West 206.2 feet; thence along a curve to the right with a radius of 92.0 feet a distance of 34.6 feet; thence North 1°06’ East 64.0 feet; thence North 88°54’ West 260.0 feet; thence North 1°06’ East 329.3 feet; thence North 89°40’ East 672.2 feet to the point of beginning proper, containing in all, 10.58 acres, more or less, shall be zoned R-1.
A part of the Northwest Quarter of the Southwest Quarter (7.86 ac.), a part of the Northeast Quarter of the Southwest Quarter (5.10 ac.), all being in Section 25, a part of the Northeast Quarter of the Southeast Quarter (1.35 ac.) Section 26, all being in Township 14 North, Range 3 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Southwest Corner of the Southwest Quarter Northwest Quarter, Section 25, Township 14 North, Range 3 East: thence South 1° 06’ West 843.6 feet to the centerline Carolyn Drive extended and the point of beginning proper; thence along the centerline of Carolyn Drive as follows: South 46°14’ East 100.0 feet in a Southeasterly direction along a curve to the left with a radius of 250.02 feet for a distance of 190.25 feet, North 89°50’ East 848.93 feet; in a Northeasterly direction on a curve to the left with a radius of 231.83 feet for a distance of 188.82 feet; thence North 43°10’ East to the Southwesterly right-of-way line Highway 63 By-pass; thence along said right-of-way line Highway 63 By-Pass; thence along said right-of-way line as follows: South 52° 28’ 30” East 150.0 feet South 20°01’ East 61.9 feet, South 27° 44’ 30” East 58.8 feet; South 61° 39’ East 223.6 feet, South 46° 24’ East 14.3 feet; thence South 88°43’ 30” West 231.7 feet; thence South 1° 38’ West 150.1 feet; thence South 89°35’ West 464.0 feet; thence South 89° 50’ West 761.0 feet; thence South 89° 56’ West 252.9 feet; thence South 89° 21’ 30” West 440.6 feet; thence North 1° 21’ East 467.6 feet; thence South 88° 39’ East 150.0 feet; thence along a curve to the right with a radius of 257.7 feet a distance of 10.87 feet to the point of beginning proper containing in all, 14.31 acres, more or less, shall be zoned R-2.
A part of the Southwest Quarter of the Northwest Quarter (5.34 ac.), a part of the Northeast Quarter of the Southwest Quarter (1.90 ac.), a part of the Northwest Quarter of the Southwest Quarter, Section 26, Township 14 North, Range 3 East (27.32 ac.), all being in Section 25, Township 14 North, Range 3 East, Craighead County, Arkansas, more particularly described as follows: Beginning at the Southwest Corner of the Southwest Quarter of the Northwest Quarter Section 25, Township 14 North, Range 3 East; thence North 1°06’ East 660.0feet; thence along the Southwesterly right-of-way line of Highway 63 By-Pass as follows: South 47° 37’ 30” East 379.6 feet, South 44° 37’ East 492.0 feet, South 49°54’ 30” East 320.1 feet, South 52° 40’ 30” East 95.9 feet, South 46° 50’ East 499.5 feet, South 38°16’ East 201.9 feet, thence South 52° 28’ 30” East 152.0 feet to the centerline of Carolyn Drive; thence along the centerline of Carolyn Drive as follows: South 43° 10’ West 238.10 feet, in a Southwesterly direction on a curve to the right with a radius of 231.83 feet for a distance of 188.82 feet, South 89° 50’ West 848.93 feet in a Northwesterly direction on a curve to the right with a radius of 250.02 feet for a distance of 190.25 feet, North 46°14’ West 100.0 feet, in a Northwesterly direction on a curve to the left with a radius of 257.70 feet for a distance of 179.91 feet; thence North 1°06’ East 646.9 feet to the centerline of Paula Drive; Thence continue North 1° 06’ East 196.7 feet to the point of beginning proper containing, in all, 34.56 acres, more or less, shall be zoned C-3.
Section 4: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are assigned and attached to Ward 4.
