AN ORDINANCE PROVIDING FOR THE REMOVAL OR RAZING OR TEARING DOWN OF ANY BUILDING, HOUSE OR STRUCTURE THAT HAS BECOME DELAPIDATED, UNSIGHTLY, UNSANITARY, OR OBNOXIOUS TO THE PUBLIC WELFARE, FOR ENFORCEMENT THEREOF, AND FOR OTHER PURPOSES

BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro:

 

Section 1: The City Inspector shall have the power to remove or raze or tear down any building, house or structure when same has become, in the opinion of the council, dilapidated, unsightly, unsafe, unsanitary, or obnoxious to the public welfare.

 

Section 2: The City Inspector shall give reasonable notice to the property owner of said condition of the building, house or structure and said owner shall have sixty days in which to cause said building, house or structure to conform to the housing code then in force in the City of Jonesboro and City Ordinances of the City of Jonesboro.

 

Section 3: If the property owner shall fail to remove or tear down such building, house or structure, or fail to cause said building, house or structure to conform to the housing code of the City of Jonesboro and Ordinances of the City of Jonesboro within said sixty days, the City Inspector shall present same to the Council for determination of whether it be in the best interest of the public welfare of the city that said building, house or structure should be torn down and removed.

 

Section 4: If the City Council determines said condition is injurious to the public welfare, the Council shall authorize the City Inspector to enter upon the premises and tear down or remove said building, house or structure.

 

Section 5: Upon the failure of the property owners to conform to Section 2 above, all costs of removing said building, house or structure, if not paid, shall become a lien against said property for  said cost in favor of the City of Jonesboro, Arkansas. The lien provided herein may be enforced at any time within 18 months after costs have been incurred by the city.

 

Section 6: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed.

 

Section 7: Should any portion of this ordinance be unconstitutional or invalid and so declared by a Court of competent jurisdiction, then the remainder of this ordinance shall not be affected by such partial invalidity.

 

Section 8: It is found and declared by the City Council that this ordinance being necessary for the preservation of the public peace, health and safety, and emergencies hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
