APPEAL HEARING - 6:15 P.M. - An appeal hearing was conducted regarding the recommendation of the Metropolitan Area Planning Commission to deny a zoning change from Residential (R-1) to Commercial (C-3), located on the north side of the 3400 Block of Colony Drive. Attorney Charles Mooney, Sr. represented Mr. Mitchell Caldwell in this matter. Mr. Mooney stated the highest and best use of the property is not residential due to a used car lot and transmission shop adjoining his client’s property. City Planner, Jeff Hawkins stated in 1995 a piece of land located near the property in question was zoned commercial three because it was non-conforming and the Metropolitan Area Planning Commission, at that time felt it should be zoned commercial to make the property conforming. Mr. Hawkins explained the current Metropolitan Area Planning Commission was concerned that more commercial zoning could adversely affect residential property values as well as the residential character of the area. He explained the MAPC determined that commercial zoning east of the railroad tracks was not advisable from a planning stand point. Mr. Doug Ward, of 3407 Colony Drive provided Council with a petition containing 12 signatures of local home owners in opposition to the rezoning. He also provided a news article from the Jonesboro Sun regarding the rezoning of property owned by Mr. Farmer in 1996. The news article quoted Mr. Ward as saying if the Farmer property is rezoned it would set a precedent for other residential-to-commercial rezonings in the area. In conclusion, Mr. Ward provided Council with three folders which contained information regarding the property and he reminded Council of the financial investment of each of the individual homeowners represented there tonight.

 

CITY COUNCIL MINUTES - December 18, 2000

 

The Jonesboro City Council met Monday, December 18, 2000 at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk Donna Jackson, City Attorney Phillip Crego, and 11 council members. Those members were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rorex was unable to attend.

 

Councilman Rega moved, seconded by Councilman Perrin to amend the minutes on page two the fourth paragraph, to state that Alderman McCall abstained from voting in the appointment of Mr. Jimmy Cooper, Jonesboro School Board President to replace Mr. Ron Bennett on the City Water and Light Board with an expiration date of February, 2002. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Perrin moved, seconded by Councilman Moore to approve the minutes as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Young moved, seconded by Councilman Moore to change the next council meeting date from January 1, 2001 to January 2, 2001 due to the New Year’s Holiday, with the Oath of Office at 6:10 p.m. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM AGRICULTURAL (AG-1) TO RESIDENTIAL (R-3), LOCATED ON THE EAST SIDE OF KATHLEEN STREET, NORTH OF MORTON DRIVE. (C.M. MOONEY, JAY HARMON)

 

Councilman Rega moved, seconded by Councilman Moore for the adoption of the ordinance, but later the motion was withdrawn. Discussion followed regarding the density for Residential (R-3) and the decrease in density if the area in the flood-way is not rezoned. Mr. Charles Mooney, Sr. stated his client was not opposed to not rezoning the area located within the flood-way. Councilman Tate moved, seconded by Councilman Moore for the adoption of the ordinance, for all the area except that which lies in the flood-way. A roll call vote was taken resulting in a six to five vote in favor of the motion. The motion failed however, due to the emergency clause which requires a b vote of the Council. The adoption was denied.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3), LOCATED ON THE NORTH SIDE OF THE 3400 BLOCK OF COLONY DRIVE. (C.M. MOONEY, MITCHELL CALDWELL)

 

Councilman Rega moved, seconded by Councilman Moore to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Young to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Moore for the adoption of the ordinance. A roll call vote was taken resulting in an eleven to zero vote against the motion. The adoption was denied.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-2) TO COMMERCIAL (C-5), LOCATED AT 824 E. MATTHEWS (C.M. MOONEY, BESSIE MCBRIDE)

 

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Copeland to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3262.

 

Councilman Perrin offered the following ordinance for first reading:

Councilman Tate moved, seconded by Councilman Moore to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Young moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Councilman Young offered the following ordinance for first reading:

 

ORDINANCE ADOPTING A 2001 BUDGET FOR THE CITY OF JONESBORO, ARKANSAS

 

Councilman Perrin moved, seconded by Young to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. The following ordinance was on second reading:

 

ORDINANCE PROHIBITING THE STORAGE UNDER CERTAIN CIRCUMSTANCES, OF JUNK AND/OR ABANDONED VEHICLES; REPEALING CERTAIN CODE PROVISIONS REGARDING SUCH VEHICLES; AND DECLARING AN EMERGENCY.

 

Councilman Perrin moved, seconded by Councilman Roddy to table the ordinance until January 15,2001 to allow time for City Attorney, Phillip Crego to provide an opinion on the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Young moved, seconded by Councilman Copeland for the adoption of a resolution requesting free temporary utility service from City Water and Light to a park building located at 3305 Dan Ave. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:51.

 

Under new business, Mr. Lemke addressed Council regarding the suggestion to open a public firing range, which is federally funded and publicly supervised. Mr. Lemke stated he had visited a public firing range in Florida and recommended the idea to Council.

 

With no further business the meeting was adjourned.
