AN ORDINANCE ANNEXING CERTAIN LANDS THAT ARE COMPLETELY SURROUNDED BY THE INCORPORATED LIMITS OF THE CITY OF JONESBORO; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 2; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, Act 314 of 1979 provides that unincorporated islands of land that have been completely surrounded by the incorporated limits of a municipality may be annexed by the municipality; and

 

WHEREAS, the City of Jonesboro has found that its incorporated limits have completely surrounded an unincorporated area hereinafter described; and

 

WHEREAS, the areas to be annexed comply with the standards for lands qualifying for annexation which are set forth in Ark. Stat. 19-307.1 and Act 314 of 1979;

 

WHEREAS, a public hearing was held August 6, 1990, regarding this proposed annexation; and

 

WHEREAS, on July 6 and July 13, 1990, a legal notice was published setting out the legal description of the territory proposed to be annexed and all property owners within the area were notified by certified mail of their right to appear at the public hearing.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That the following described unincorporated areas which are completely surrounded by the City Limits of the City of Jonesboro are hereby annexed to the City of Jonesboro and said territory shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

SECTION 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:

 

A part of the Southwest Quarter of Section 9, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows:

 

Commencing at the Southeast Corner of Shady Park Heights Addition to Craighead County, Arkansas; thence North 0°15' East 515.0 feet to the point of beginning proper: thence continue North 0°15' East along the East line of said Shady Park Heights Addition 888.1 feet to the South right-of-way line of Highway No. 18; thence North 87°47' East along said right-of-way line 240.1 feet to the Southwesterly right-of-way line of Highway No. 63 Bypass; thence South 70°06' East along said right-of-way line 208.0 feet; thence South 86°05' East along said right-of-way line 227.4 feet; thence South 27°50' East along said right-of-way line 507.2 feet; thence South 45°06' East along said right-of-way line 505.6 feet; thence South 89°03, West 432.9 feet; thence North 0°27' East 15.0 feet; thence South 89°11' West 828.1 feet to the point of beginning proper and containing 17.63 acres, more or less; LESS AND EXCEPT that portion hereof which lies within 300 feet of the centerline of U.S. Highway 63.

 

SECTION 3: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning as Commercial - 3 (C-3).

 

SECTION 4: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward 2.

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
