The minutes of the November 13, 2001 Board of Adjustment meeting were approved as prepared on a motion by Krennerich, second by Gott and unanimous vote.
#1 CU02-2 Medic One requested approval of a conditional use to allow a helicopter pad to be constructed in the Commercial C-3 General Commercial District. The address of the property is 3301 S. Caraway Road and the general location of the property is on the west side of Caraway Road, south of Parker Road.
Proponents stated that the company was going to have to relocate their operation to cut expenses whether they relocated here or somewhere else. With the existing ambulance service on site, personnel would already be in place to staff the needs of the air service too. They further stated that noise from the helicopter would not last as long as a regular ambulance. Their flights average 15 to 33 per month and their departure time is three minutes from the moment of starting the aircraft. It was stated they had air space approval from FAA.
Concerns were expressed by several in attendance regarding potential conflicts with existing air patterns and the detrimental effect this would have on the development of adjacent properties. Glenn Lovett, Attorney for some of the opponents, questioned if the proposal would even be allowed as a conditional use in C-3 zoning. Mr. Lovett stated that his interpretation of the zoning ordinance would not permit this use as a conditional use in C-3 zoning. Concerns were also expressed about fuel storage tanks and their containment.
Mr. Lovett further informed the Commissioners that there is a 50,000 foot overlay around the existing airport that prohibits anything in this air space that would interfere with aircraft arriving or departing from the airport and this proposal would violate that code provision as well. Safety for people in the area and adverse impacts on adjacent residential and commercial developments were also cited as major concerns.
Glenn Batten, City Planner, stated that the main issue to be decided was what this proposed location had to offer that was not available at the airport. Group living quarters is the main advantage not available at the airport. Mr. Batten explained that the proposed site is a relatively tight site and on the other hand there is plenty of space at the airport, not a lot of structures there, and the operations there are strictly for air traffic. Mr. Batten noted that most all required facilities are available for a helicopter service at the airport which is the most logical location for a heliport and therefore recommended the proposal be disapproved.
Claude Martin, City Engineer, stated that the base flood elevation needs to be shown on the plans for the slab around the fuel tank.
Mr. Street made a motion to disapprove the request for a conditional use based upon the City Planner’s recommendation and stating that the airport is the most appropriate place for the heliport and further that the criteria for conditional use had not been met. The motion was seconded by Mr. Krennerich. Voting was 5 in favor, 1 abstaining, 0 opposed. Those voting aye were Street, Krennerich, Gott, Johnson, Beadles. Those abstaining were Damron. MOTION CARRIED, REQUEST DISAPPROVED.
#2 CU02-3 Jonesboro Memorial Park Cemetery requested approval of a conditional use to add a 24' X 16' storage and display building. The address of the property is 3910 Harrisburg Road and the general location of the property is on the east side of Harrisburg Road, south of Lakewood Drive.
City Planner Glenn Batten stated that the proposed structure was an ancillary use to the principal use which is a cemetery. The structure will be used to display items used for interment.
A motion was made by Mr. Krennerich and seconded by Mr. Damron to approve the request. Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.
#3 FP02-1 Bill Benton requested final approval of plans for Murray Wood Subdivision containing 19 lots on 11.79 acres. The general location of the property is on the north side of Neely Road, west of Neely Lane.
Glenn Batten reiterated the requirement to provide a 90° intersection at Neely Road and noted that the stipulations from the preliminary approval had been met. Claude Martin, City Engineer, stated that rip rap was needed at the outfall of the drainage pipes to prevent erosion. Mr. Martin also requested information to ensure that the outflow from the pipes can get to the large ditch.
George Hamman, Project Engineer, stated that the street would be positioned within the right of way at a 90° alignment with Neely Road and that he would work with the City Engineer on the drainage issues.
Mr. Krennerich made a motion to approve the request with the following stipulations:
1. Making the intersection with Neely Road a 90° intersection
2. Install rip rap at the ends of the drainage pipes
3. Revising plans to include drainage information regarding how the surface drainage reaches the large ditch. Revised plans must be approved by the City Engineer
The motion was seconded by Mr. Gott. Voting was 5 in favor, 1 opposed. Those voting aye were Johnson, Krennerich, Street, Gott, Beadles. Those voting no were Damron. MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.
#4 FP02-2 Kent Arnold requested final approval of plans for Key West Subdivision Phase I containing 36 lots on 9.408 acres. The general location of the property is on the east side of Paragould Drive, south of Cypress Springs Road.
Mr. Arnold informed the Commissioners that he was in agreement to provide the drainage pipe under the street entering the subdivision as discussed with the City Engineer as well as the street improvements on the east side of Paragould Drive. Glenn Batten, City Planner noted that the preliminary stipulations had been complied with. Items #4 and #5 were considered simultaneously.

#6 MP02-1 Ruben Griffin requested approval of a minor plat containing one lot on 12.97 acres. The general location of the property is on the north side of Southwest Drive, west of Oak Park Drive.
This replat combines property adjoining Southwest Drive with the property that was rezoned a few months ago. Street frontage was a concern at that time. It was pointed out that Oak Park Drive, as drawn on the plat, crosses this property and is used by the public now and for many years before. George Hamman stated that the AHTD was making changes and would probably relocate the street.
Mr. Krennerich made a motion to approve the request subject to dedicating 60' of right of way for Oak Park Drive where it crosses this property unless the AHTD has plans otherwise. Plans will need to be reviewed and approved by the City Engineer. The motion was seconded by Mr. Street. Voting was 5 in favor, 0 opposed. Those voting aye were Krennerich, Johnson, Damron, Gott, Street. MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

Mr. Krennerich made a motion to approve the request with the following stipulations:
1. Lot 2, which is a 60' wide lot, is not to be used as a street until the MAPC reviews and approves the overall master development plans for this property and surrounding property. Street locations, utility plans, land use, etc... will be a part of the review
2. Dedicating the right of way dedication for Harwood Drive to the west property line of Lot 1
3. Installing curb and gutter and street widening on the south side of Harwood Drive

Members of the Jernigan family plan to build homes on the lots if approved as proposed. The lot is very large, but doesn’t have enough frontage to provide both new lots with 60' of frontage. One lot has 60' of frontage and one lot has 30' of frontage.
