CITY COUNCIL MINUTES NOVEMBER 20, 1978

 

The Jonesboro City Council met in regular session, Monday, November 20, 1978, at 7:30 p.m. Present, Park, Hinson, Shelton, Bridger, Hannah, Haigler, Province, Stricklin, Smith and Shepard. Absent, Mayor, City Clerk and Minx. Ms. Haigler presided over the meeting in the absence of Mayor Stallings.

 

On motion by Mr. Park, seconded by Mr. Smith, the minutes of November 6, 1978, were approved as mailed.

 

The following resolution was offered by Mr. Hannah:

 

A RESOLUTION AUTHORIZING A MEMORANDUM OF INTENT BY AND BETWEEN THE CITY OF JONESBORO, ARKANSAS, AND DANA CORPORATION PERTAINING TO THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS FOR FINANCING THE COST OF ACQUIRING CONSTRUCTING AND DEVELOPMENT REVENUE BONDS FOR FINANCING THE COST OF ACQUIRING CONSTRUCTING AND EQUIPPING INDUSTRIAL FACILITIES; AND PRESCRIBING OTHER MATTERS RELATING THERETO

 

On motion by Mr. Hannah, seconded by Mr. Stricklin and unanimous vote of council, the resolution was adopted. The resolution was given the number 1978:21.

 

Mr. Shepard moved that the City sell thirty-four (34) acres of land located in the Industrial Park for $5000.00 an acre to Dana Corporation and authorized the Mayor and City Clerk to execute same. The motion was seconded by Mr. Shelton, all voted aye.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE CREATING THE DEPARTMENT OF CODE ENFORCEMENT

 

On motion by Mr. Stricklin, seconded by Mr. Shelton and unanimous vote of council, the ordinance was tabled for two weeks.

 

Mr. Park offered the following ordinance:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED SEPTEMBER 11, 1978; PROVIDING FOR ZONING CLASSIFICATION OF SAID LANDS, ASSIGNING SAID ANNEXED LAND TO WARD 3; AND FOR OTHER PURPOSES

 

Mr. Park moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Smith, all voted aye.

 

Mr. Stricklin offered the following ordinance:

 

AN ORDINANCE TO AMEND SECTION 13-70 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, INCREASING THE LICENSE TAXES FOR ARKANSAS LOUISIANA GAS COMPANY AND THE TIME WHEN SAID TAXES WILL BE DUE

 

The rules were suspended and the ordinance placed on second reading on motion by Mr. Stricklin, seconded by Mr. Smith and all council voted aye.

 

The following ordinance was offered by Mr. Shepard:

 

AN ORDINANCE TO AMEND ORDINANCE #1249, AN ORDINANCE WHEREBY THE CITY OF JONESBORO, ARKANSAS AND SOUTHWESTERN BELL TELEPHONE COMPANY, A MISSOURI CORPORATION, AGREE THAT THE TELEPHONE COMPANY SHALL CONTINUE TO OPERATE ITS TELEPHONE SYSTEMS AND ALL BUSINESS INCIDENTAL TO OR CONNECTED WITH THE CONDUCTING OF A TELEPHONE BUSINESS AND SYSTEM IN SAID CITY, AND ERECT AND MAINTAIN ITS PLANT CONSTRUCTION AND APPURTENANCES ALONG, ACROSS, ON, OVER, THROUGH AND ABOVE AND UNDER ALL PUBLIC STREETS, AVENUES, ALLEYS, PUBLIC GROUNDS AND PLACES IN SAID CITY; THAT THE CITY SHALL RECEIVE AN ANNUAL PAYMENT FROM THE TELEPHONE COMPANY; AND REPEALING ALL ORDINANCES AND AGREEMENTS IN CONFLICT HEREWITH

 

Mr. Shepard moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Park, all voted aye.

 

Mr. Shelton offered the following ordinance:

 

AN ORDINANCE TO AMEND CHAPTER 13, ARTICLE 1 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, THE SAME DEALING WITH LICENSE AND PRIVILEGE TAXES

 

Mr. Smith moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Shelton, all voted aye.

 

Mr. Park offered the following resolution:

 

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS, AUTHORIZING FILING OF COMMUNITY DEVELOPMENT PROGRAM APPLICATION, APPROVING PLANS, MAKING CERTAIN ASSURANCES TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND AUTHORIZING THE MAYOR TO CERTIFY CONTENTS OF THIS RESOLUTION

 

The resolution was adopted on motion by Mr. Park, seconded by Mr. Smith and unanimous vote of council. The resolution was given the number 1978:22.

 

Mr. Smith offered the following resolution:

 

RESOLUTION OF CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS AUTHORIZING THE EXECUTION OF A COOPERATION AGREEMENT BETWEEN THE CITY OF JONESBORO, ARKANSAS AND THE JONESBORO URBAN RENEWAL AND HOUSING AUTHORITY FOR THE FIFTH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, JONESBORO, ARKANSAS 1979-80

 

Mr. Smith moved that the resolution be adopted, seconded by Mr. Park with all present voted aye except Mr. Shelton who abstained. The resolution was given the number 1978:23.

 

On motion by Mr. Hannah, seconded by Mr. Shelton and unanimous vote of council, the condemnation proceedings of property located at Main and Nettleton where rescinded, and the owners of the building are to present to council a plan for renovation at the first meeting in January.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS, ZONED R-1, ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, LOCATED IN WARD 3, BY ORDER OF THE COUNTY COURT DATED SEPTEMBER 11, 1978

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, DATED JULY 24, 1978; PROVIDING FOR ZONING CLASSIFICATION OF SAID LANDS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, AND FOR OTHER PURPOSES

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

There being no further business to come before the council, the meeting adjourned.
