CITY COUNCIL MINUTES - FEBRUARY 19, 1990

 

The Jonesboro City Council met in regular session at 7:30 p.m. Present were Mayor, City Clerk, City Attorney and Aldermen Hannah, Park, Stricklin, Evans, Shelton, Province, Mays, Strauser, Hinson and Nix. Aldermen Bridger and Sanderson were absent. 

 

The minutes of February 5, 1990, were approved as mailed on motion by Mr. Nix, seconded by Mr. Shelton. All voted aye.

 

Mr. Stricklin moved, seconded by Mr. Evans to reappoint to the CWL Board of Directors Pete Shelton, Ward 2; George Love, Ward 1; and to approve the Jonesboro School Board position of Ron Bennett. All voted aye.

 

The following bid was up for review:

 

90:06 - Mechanical equipment - FAA Building

Purchasing Agent, Steve Kent, stated that the money would be used for the tower, chemical treatment for water pumps, and preventative maintenance. The bid is for a one year time period with a 3 year option. Mr. Shelton moved, seconded by Mr. Stricklin to accept the low bid meeting specifications from RGB Mechanical for $495.00. All voted aye.

 

Mr. Shelton offered a resolution setting the dates of Clean Sweep from March 24-31, 1990. Mr. Shelton moved, seconded by Mr. Province to approve the resolution. All voted aye. The resolution was given the number 1990:11.

 

Mr. Hinson moved, seconded by Dr. Strauser to approve the resolution offered by Mr. Hinson as requested by the Police Department Traffic Safety Officer for speed limits as follows:

a) 35 mph on Lawson Rd. between Hwy 49 S. and S. Culberhouse

b) 40 mph on Lawson Rd. from S. Culberhouse Rd. to city limits east

c) 35 mph on Cottage Home Rd. from Hwy 18 S. to U. S. 63

d) 35 mph on Moore Rd. from Hwy 18 S. to city limits

e) 35 mph on Heath Rd. from Hwy 18 S. to city limits

f) 35 mph on C. W. Post Rd. in its entirety to city limits east.

All voted aye. The resolution was given the number 1990:12.

 

Mr. Evans offered a resolution condemning property located at 317 Welch St. Mr. Evans moved, seconded by Mr. Stricklin to approve the condemnation of said property. All voted aye. The resolution was given the number 1990:13.

 

Mr. Hinson offered the following ordinance for first reading:

 

ORDINANCE TO AMEND CHAPTER 14:20, MOBILE HOME AND MOBILE HOME PARKS, OF THE CODE OF ORDINANCES TO AMEND ALL SECTIONS RELATING TO MOBILE HOMES EXCEPT THOSE REGARDING MOBILE HOME PARKS TO ADD A NEW SECTION, 14.20.03 MANUFACTURED HOME SUB-DIVISION

 

Following discussion, the following amendments to the ordinance were made:

 

a) Mr. Province moved, seconded by Mr. Evans in 14.20.02, §1b - to insert the wording “multi-section” following “One Class A”. All voted aye.

 

b) Mr. Evans moved, seconded by Mr. Shelton in 14.20.05, §1 - to change the wording to reflect the title of the “Condemnation Code Enforcement Officer” to replace “Condemnation and Weeds / Grass Officer.” All voted aye.

 

c) Mr. Hannah moved, seconded by Mr. Shelton in Section 14.20.03, §1- to change the authority from the Board of Zoning Adjustment to the City Council. This allows the Council to review hardship cases involving placement of mobile homes in conventional residential neighborhoods, adding that the Board of Zoning Adjustment to City Council. This will allow the Council to review hardship cases involving the placement of mobile homes in conventional residential neighborhoods. A roll call vote was taken and Aldermen Hannah, Park, Stricklin, Evans, Shelton, Province, Hinson and Nix voted in the affirmative. Voting nay were Mays and Strauser. The Motion passed 8-2.

 

c) Mr. Nix moved, seconded by Mr. Hannah to amend Section 14.20.05, §1 - regarding procedure of condemnation to reflect the condemning of a mobile home to be the same as residential homes. A roll call vote was taken and all voted aye.

 

d) Mr.  Hannah moved, seconded by Mr. Evans to amend Section 14.20.04, to add wording “ - Special Use”. All voted aye.

 

John Thomas, of Rt. 7 voiced objection to 2 lots off Duncan Rd. that were improved for mobile homes, yet the proposed ordinance would prohibit use of his property for mobile homes, adding  that he receives no tax credit from the federal government to rent lots for mobile homes even though the property in currently being used for that purpose.  Mayor Brodell stated the property could be rezoned R-2, a zoning district that allows mobile homes or used for conventional residences. 

 

Mr. Mays moved, seconded by Mr. Evans to suspend the rules and place on second reading.  All voted aye. The ordinance was read for the second time. Dr. Strauser moved, seconded by Mr. Hinson to suspend the rules and place the ordinance on third reading. All voted nay. The ordinance was read for the third time. Mr. Province moved, seconded by Mr. Shelton to adopt the ordinance with the emergency clause. All voted aye with the exception of Mr. Evans who voted nay. The ordinance was given the number 2257.

 

Mr. Nix offered the following ordinance for first reading: (Rez /AG-1 to I-2, E side of Commerce N of Krueger, Painter)

 

AN ORDINANCE TO AMEND #954 KNOWN AS THE ZONING ORDINANCE DECLARING A CHANGE IN THE ZONING BOUNDARIES AND FOR OTHER PURPOSES

 

Mr. Parks moved, seconded by Mr. Nix to suspend the rules and place the ordinance on second reading. All voted aye. The ordinance was read for the second time. Mr. Stricklin moved, seconded by Mr. Province to further suspend the rules and place the ordinance on third reading. All voted aye. The ordinance read for the third time. Mr. Evans moved, seconded by Mr. Stricklin to adopt the ordinance with the emergency clause. All voted aye. The ordinance was given the number 2258.

 

Dr. Strauser moved, seconded by Mr. Nix to make a final settlement on the Railroad Spur in the new Industrial Park to appropriate $5146.00 from Capital Improvement unappropriaated funds to Railroad Spur line item. All voted aye.

 

Dr. Strauser offered the following ordinance for first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF CULVERT WORK ON WILLOW ROAD FOR THE CITY OF JONESBORO, ARKANSAS AND FOR OTHER PURPOSES

 

Mr. Hannah moved, seconded by Mr. Mays to suspend the rules and place the ordinance on second reading. All voted aye. Mr. Hannah moved, seconded by Mr. Nix to further suspend the rules and place the ordinance on third reading. All voted aye. Mr. Mays moved, seconded by Mr. Hinson to adopt the ordinance with the emergency clause. All voted aye. The ordinance was given the number 2259.

 

Dr. Strauser moved, seconded by Mr. Nix to grant Mayor Brodell the authority to allow general expense for the Police Department personnel for travel as recommended by the Police Chief. All voted aye. 

 

Jack Richardson voiced objections to the establishment of a mission in an old church building on U. S. 49 on the northeast edge of the city to feed and shelter transients. Mr. Nix asked the City Attorney to research the definition of a “church” and Mayor Brodell asked Ms. Honeycutt to research the matter regarding the mission and render a legal opinion within forty-eight (48) hours.
