CITY COUNCIL MINUTES - November 18, 1996

 

The Jonesboro City Council met Monday, November 18, 1996, at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk, Donna K. Jackson, City Attorney; Phillip Crego, and 11 council members. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Vice Mayor, Gary Harpole presided in the absence of Mayor Brodell.

 

The minutes of November 4, 1996, were approved as delivered by Councilman Perrin and seconded by Councilman Young. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

The following ordinance was on the third reading:

 

ORDINANCE TO VACATE A 120.0' DRAINAGE EASEMENT AND A 146.6' UTILITY EASEMENT ON LOT 6, PARDEW NORTH ADDITION (GUY PARDEW & LAN METZ/ ED STEPP)

 

No motion was made regarding this ordinance due to the need for further information. The Council requested it be placed on the December 2, 1996, agenda so a decision could be made at that time.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Dennis Zolper/Belz/Burrow II)

 

At Mr. Dennis Zolper’s request, Councilman Rega moved, seconded by Councilman Kelton to table the third reading until December 2, 1996. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Jimmy Doyle Hunt/Dan Mulhollen)

 

At the request of Attorney Berl Smith, Councilman Kelton moved, seconded by Councilman Vance to table the third reading until December 16, 1996. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

The following ordinance was on the third reading:

 

ORDINANCE TO VACATE THE ALLEY RUNNING WEST OF BAKER STREET INTO THE EAST 45 FEET OF LOT 5, BLOCK 2, OF MORSE’S ADDITION (James & Mary Lackey)

 

Councilman Tate moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2734.

 

Councilman Rega offered the following ordinance for the first:

 

ORDINANCE TO AMEND ORDINANCE NO. 1365 KNOWN AS THE AMBULANCE ORDINANCE BY SETTING STANDARDS FOR PERSONS OR FIRMS TO OPERATE EMERGENCY AND NON-EMERGENCY TRANSPORT SERVICES WITHIN THE CITY LIMITS OF JONESBORO, ARKANSAS                     

 

Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Perrin moved, seconded by Councilman Vance to suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Young moved, seconded by Councilman Tate for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye, with the exception of Councilman Wise who abstained from voting. Those members voting aye were: Vance, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2735.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (E.T.A., Inc/Dan Mulhollen)

 

Councilman Tate moved, seconded by Councilman Roddy to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Wise moved, seconded by Councilman Tate to suspend the rules and place on the third and final reading. A roll-call vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Tate moved, seconded by Councilman Kelton for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2736.

 

The following ordinance was up for the second reading:

 

ORDINANCE TO AMEND CHAPTER SIX OF THE JONESBORO CODE OF ORDINANCES PROVIDING THAT ANIMAL CONTROL OFFICERS ASSUME THE PRINCIPAL RESPONSIBILITY FOR ANIMALS; AMENDING THE AGE FOR DOGS BEING KEPT OVER FIVE, AMENDING THE DATE WITHIN WHICH A VACCINATION IS REQUIRED FOR ANIMALS AND FOR OTHER PURPOSES

 

Councilman Vance moved, seconded by Councilman Rega to table the ordinance indefinitely and requested a joint committee meeting between Planning and Animal Control for the purpose of making recommendations to the full Council. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Jay Harmon AG-1 to I-1)

 

No further action was taken regarding this ordinance.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Jay Harmon R-1 to I-1)

 

No further action was taken regarding this ordinance.

 

Councilman Vance moved, seconded by Councilman Young for the adoption of a resolution condemning the following four properties located within the city limits of Jonesboro, Arkansas:

 

2831 Brookhollow Cove                     James Robinette, Owner

813 East Washington                     Lenever Smith, Owner

526 West Woodrow                     Lorena Findley, Owner

312 East Word                     Bonnie Rusher, Owner

 

A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The resolution was given the number 1996:54.

 

Councilman Perrin moved, seconded by Councilman Young for the adoption of a resolution setting a public hearing for 6:20 p.m. on December 2, 1996, in Municipal Court. The purpose of the public hearing is to hear discussion on the vacating street right-of-ways for Norma Drive, Charles Drive, and China Drive, all located in the Metzler Addition. The request for the public hearing was made by St. Bernards Hospital, Inc. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The resolution was given the number 1996:55.

 

Councilman Vance moved, seconded by Councilman Young to set an Appeal Hearing for 6:00 p.m. on December 2, 1996, in Municipal Court. The purpose of the appeal hearing is to hear comments regarding the MAPC denial of a site plan approving two additional dwelling units to be built on a lot with an existing home at 1115 W. Jefferson. The appeal hearing was requested by Mr. Jim Darnell. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole

 

Councilman Vance moved, seconded by Councilman Young to set an Appeal Hearing for 5:40 p.m. on December 2, 1996, in Municipal Court. The purpose of the appeal hearing is to hear comments regarding denial by the MAPC to approve a rezoning for 1.82 acres located on the east side of Harrisburg Road, south of Gladiolus Drive. Mr. David Onstead and Mr. Gary Childers have requested the appeal hearing. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

The following Bids were reviewed:

 

96:30 - Crawler Tractor Dozer - Sanitation/Landfill

Councilman Wise moved, seconded by Councilman Young to table the bid until December 2, 1996.

 

96:31 - Roof - Forum

Councilman Vance moved, seconded by Councilman Tate to accept the only bid offered, by Jonesboro Roofing for $50,987.60 (including tax) with $32,055.60 to come from Capital Improvements. The remainder of the balance is to come from a grant received by the City of Jonesboro.

 

Under new business, Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (M.J. Fox)

 

No further action was taken regarding this ordinance.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Kenneth Sulcer)

 

No further action was taken regarding this ordinance.

 

Councilwoman Hannah moved, seconded by Councilman Province to allow non-uniform city employees off the Friday after Thanksgiving. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

Councilman Perrin moved, seconded by Councilman Young to appropriate $13,534.73 to come from Unallocated Sales Tax for payment to the law firm of Womack, Landis, Phelps, McNeill and McDaniel in the legal dispute brought by FBI.

 

With no further business, the meeting was adjourned.
