AN ORDINANCE TO AMEND ORDINANCE #2257, MOBILE HOMES AND MOBILE HOME PARKS, SECTION 14. 20. 02, (3) TO SPECIFY THE PROCEDURES FOR NOTIFICATION TO ADJACENT PROPERTY OWNERS OF A PROPOSED MANUFACTURED HOUSING SUBDIVISION, AND SECTION 14. 20. 04, INDIVIDUAL MANUFACTURED HOME OR MOBILE HOME NOT IN SUBDIVISION, PARK OR COURT -SPECIAL USE, OF THE CITY OF JONESBORO, ARKANSAS, TO ALLOW PLACEMENT OF SAME IN THE R-1 ZONING DISTRICT, AND FOR OTHER PURPOSES.

BE I ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That Ordinance #2257, Section 14. 20. 02, (3) is hereby amended to read as follows:

 

(3) Procedure for approval of manufactured housing subdivision. The procedure for notification to adjacent property owners of a proposed manufactured housing subdivision shall be the same as for a residential planned unit development. All applications for manufactured housing subdivisions must be reviewed by the Metropolitan Area Planning Commission and approved by the City Council in accordance with the requirements of Ordinance Numbers 1790 and 1962. All manufactured housing to be located within any approved manufactured housing subdivision must be a class “A” manufactured home. The minimum size for any manufactured housing subdivision shall be the same as for a residential planned unit development: R-1 -5 acres, R -2 - 2 acres, R -3 -1 acre.                                          

 

SECTION 2: That section 14. 20. 04 of the City of Jonesboro Code of Ordinances is hereby amended as follows:

 

(3) The Metropolitan Area Planning Commission may grant approval of a Special Use Permit for an individual Class “A” mobile home on a lot in the R-1 zoning district when it shall find that said manufactured home of mobile home shall meet the criteria as listed in Section 14. 20. 04 (1) of the Code of Ordinance of the City of Jonesboro, Arkansas.

 

(A) All applications for Special Use Permits in the R-1 zoning district shall be submitted on forms provided by the Planning and Inspection Department of the City of Jonesboro.

(1) The deadline for submitting applications shall be a minimum of twenty (20) days prior to the regularly scheduled meeting date, which is the second Tuesday of each month.

(2) Notice of public hearing shall be published at least one (1) time, twenty (20) days prior to the hearing.

(3) The applicant must present the written consent of sixty-five percent (65%) of the neighbors or occupants living within twelve hundred feet (1,200') of the mobile home site.

(4) A twenty-five dollars ($25.00) filing fee shall be required upon submission of the Application.

 

(B) If approval of an application shall be granted, a Special Use permit shall be issued at the same fee as a regular building permit.

(1) Special Use permits in the R-1 zoning district shall be issued for a maximum of five (5) years, unless an extension shall be granted.

 

(C) If approval of an application shall be denied, the applicant may appeal the decision to the City Council in accordance with the requirements of Sections 2. 20. 06, 2 20 07, 2.20.08 and 2.20.09 of the Code of Ordinances of the City of Jonesboro.

(1) Any person living and/or owning property within the specified 1,200' of the proposed mobile home site may also appeal any decision of the Metropolitan Area Planning Commission to the City Council in accordance with the guidelines listed in the preceding Section C above.

 

SECTION 3: If for any reason any portion this ordinance is held to be invalid, such invalidity shall in a way affect the remaining portions thereof which are valid, but such valid portions shall remain in full force and effect.

 

SECTION 4: It is found and declared by the City Council that as emergency exists and this ordinance, being necessary for the preservation of the public peace, health, and safety, shall take effect from and after its passage and approval.
