PUBLIC HEARING 7:00 P.M. SOUTHWICK DRIVE - A public hearing was held regarding the abandonment of an unimproved portion of Southwick Drive, between lots 30 and 32, off Lawson Road in Valley View. No opposition was voiced.

 

PUBLIC HEARING 7:15 P.M. ALLEY OFF JACKSON AVE - A public hearing was held regarding an alley off Jackson Avenue, located between Madison and Union Streets. The decision was made to hold until an agreement could be met with Arkla Gas.

 

CITY COUNCIL MINUTES - MAY 17, 1993

 

The Jonesboro City Council met in regular session at 7:30 p.m. Present were the Mayor, City Clerk, City Attorney and all Council Members, with the exception of Councilman Province who was unable to attend.

 

The minutes of May 3, 1993, were approved as amended by motion of Councilman Harpole seconded by Councilman Perrin. The minutes were amended to read "Committee" rather than "Department" on page five regarding the recommendation to the Civil Service Commission. A roll call vote was taken resulting in all council members voting aye.

 

Item E from the agenda, rezoning for Mr. Rees' property was addressed first.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. ROBERT REES REZONING

 

Councilman Vance questioned the purpose behind the rezoning. Mr. Rees stated if the property was destroyed by fire it would not be replaced under the current rezoning classification, and for re-sale purposes. Councilman Vance asked was it Mr. Rees intentions to build more apartments in this area. Mr. Rees stated he did not intend to build more apartments in this location. Councilman Vance then asked if the Non-Conforming Ordinance would not allow Mr. Rees to build further back and was told due to Mr. Rees not registering he did not qualify. Several citizens spoke in opposition to the rezoning. Ron Freeman submitted several petitions of property owners opposed to the rezoning. Dr. Eugene Smith read a letter from Michael Johnson, Curriculum Director of Nettleton Public School District, expressing concerns regarding the educational well-being and physical safety of students attending University Heights Elementary School should the rezoning ordinance be adopted. Finally, Paul Eldridge expressed his disapproval due to drainage problems in the area. Councilman Vance stated he would offer an amendment to the Non-Conforming Ordinance which would extend the filing deadline for registration of non-conforming use to December 31, 1993. Councilman Vance moved, seconded by Councilman Harpole for the adoption of the rezoning ordinance. A roll call vote was taken resulting in all council members voting nay. The ordinance was denied.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. GEORGE HAMMAN/ FLOYD VUNCANNON

 

Councilman Evans moved, seconded by Councilman Kelton for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. The ordinance was given the number 2473.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. SHAHIN RIAHI/STUCK ASSOCIATES

 

Councilman Harpole moved, seconded by Councilman Vance for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. The ordinance was given the number 2474.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. CALVIN CONNELL

 

Due to no site plan the decision was made to hold the third reading for the next council meeting.

 

Councilman Evans offered the following ordinance for the first reading:

 

AN ORDINANCE TO VACATE AND ABANDON A PORTION OF AN ALLEY, LOCATED OFF JACKSON STREET. DONN MIXON

 

Councilman Harpole moved, seconded by Councilman Vance to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. The third reading was delayed to allow an agreement to be made with Arkla Gas.

 

Councilman Harpole offered the following ordinance for the first reading:

Councilman Evans moved, seconded by Councilman Wise to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye.

Councilman Vance moved seconded by Councilman Harpole to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye.

Councilman Harpole offered the following ordinance for the first reading:

Councilman Harpole offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. SKIP MOONEY

 

Councilman Harpole moved seconded by Councilman Perrin to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND SECTIONS 14.08.02 (D)4, 14.08.03 (D)4, AND 14.08.04 (D)4, OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS TO CHANGE THE CRITERIA FOR ACCEPTABLE ACCESSORY BUILDINGS IN RESIDENTIAL ZONING DISTRICTS.

 

Councilman Vance requested the ordinance be read the third and final time at the next council meeting. Councilman Hannah questioned Jim Shaw, City Planner if a storm shelter would be considered an accessory building, and requested that information be available by the next meeting.

 

Councilman Harpole requested that Item L from the agenda be pulled due to scheduling conflicts of the Industrial Committee. Councilman Hannah moved, seconded by Councilman Kelton to table Item L till the next council meeting. A roll call vote was taken resulting in all council members voting aye.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZED PURCHASE OF REPAIR PARTS FOR A CASE 1550 DOZER

 

Councilman Evans moved, seconded by Councilman Harpole to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. Councilman Evans moved, seconded by Councilman Wise to further suspend the rules and place on the third and final reading. A roll call vote was taken resulting in all council members voting aye. Councilman Harpole moved, seconded by Councilman Vance for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. The ordinance was given the number 2475.

 

Councilman Harpole moved, seconded by Councilman Perrin to adopt a resolution condemning property located at 3706 Griffin. A roll call vote was taken resulting in a nine to two vote in favor of the motion. Those council members voting aye were: Wise, Evans, Ingram, Mullenix, Bowers, Perrin, Vance, Mays and Hannah. Those council members voting in opposition were: Kelton and Harpole. The resolution was given the number 1993:19.

 

Under new business Mayor Brodell stated a meeting would be set to discuss traffic plans, and encouraged Councilman Vance and Councilman Harpole to attend, along with the appointed traffic committee. The meeting will be open to the public.

 

Mayor Brodell also stated the City of Jonesboro had received an appreciation plaque for its work with the Jonesboro Jaycees.

 

Finally, Mayor Brodell read a proclamation declaring May 23rd through the 29th to be Emergency Medical Services Week and commended the work of Emergency Services in Jonesboro.

 

Councilman Evans reported he had attended a conference in St. Louis which pertained to the Americans with Disabilities Act. Councilman Evans stated even though Jonesboro was in compliance with ADA, there was still work to be done, and he had given the guidelines to the Planning and Street Departments.

 

Councilwoman Ingram read a letter from Mike Smith of Dimensions Incorporated which reported a large increase in seat belt usage due the publicity of the STEP program. Councilwoman Ingram also expressed her appreciation to Mayor Brodell for the quick response to the dog pound problems.

 

Councilman Mullenix made a recommendation on behalf of the Mosquito Control Committee regarding the hiring of Tony Miles of Bono for 1993 and 1994 at a substantial savings compared to Walnut Ridge. The committee reached this decision based on the cost increase of flying time of Walnut Ridge, at $414.00 per hour compared to Mr. Miles at $325.00 an hour flying time.

 

Councilman Kelton reminded everyone of the Corp. of Engineer Workshop regarding drainage for June 3, 1993, at 7:00 P.M.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 2280, THE NON-CONFORMING USE ORDINANCE, SECTION 13, TO EXTEND THE FILING DEADLINE FOR PROPERTY OWNERS TO REGISTER THEIR NON-CONFORMING USE AS IT EXISTED ON APRIL 7, 1989; AND FOR OTHER PURPOSES

 

Councilman Vance moved, seconded by Councilman Harpole to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye.

 

Councilman Vance moved, seconded by Councilman Harpole to accept the recommendation of the General and Personnel Committee to enter into a contract with Arnold & Stacks to begin preliminary work on the Safeway building to determine if it is structurally sound and financially fit to be renovated. Councilman Vance stated the cost would be a percentage cost based on the state building guidelines, and the all seismic codes would be adhered to. A roll call vote was taken resulting in all council members voting aye with the exception of Councilman Bowers.
