BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION ONE: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the 15' Road Right of Way designated as follows:
 
DESCRIPTION:
A PORTION OF THE SOUTH 15 FEET OF LOT 5 OF ROOK SUBDIVISION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 33, TOWNSHIP 14 NORTH, RANGE 4 EAST, CRAIGHEAD COUNTY, ARKANSAS, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
 
BEGINNING AT THE SOUTHEAST CORNER OF LOT 5 OF ROOK SUBDIVISION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 33, TOWNSHIP 14 NORTH, RANGE 4 EAST, CRAIGHEAD COUNTY, ARKANSAS, AS SHOWN BY PLAT RECORDED IN PLAT BOOK 123 PAGE 132 AT JONESBORO, AR:  THENCE SOUTH 88°56'26" WEST, ALONG THE SOUTH LINE OF SAID LOT 5, A DISTANCE OF 836.92 FEET TO A POINT, SAID POINT LYING ON THE SOUTHERLY RIGHT-OF-WAY LINE OF HIGHWAY 63B EAST:  THENCE NORTH 32°23'27" EAST, ALONG SAID SOUTHERLY RIGHT-OF-WAY LINE, A DISTANCE OF 17.98 FEET:  THENCE NORTH 88°56'26" EAST, DEPARTING FROM SAID SOUTHRLY RIGHT-OF-WAY LINE, A DISTANCE OF 827.24 FEET TO A POINT, SAID POINT LYING ON THE EAST LINE OF LOT 5 OF ROOK SUBDIVISION:  THENCE SOUTH O1°11'27" EAST, ALONG SAID EAST LINE, A DISTANCE OF 15.OO FEET TO THE POINT OF BEGINNING.
 
CONTAINING IN ALL 12,481 SQ. FT. OR O.29 ACRES, MORE OR LESS.
 
SUBJECT TO EASEMENTS, RESTRICTIONS, RESERVATIONS AND RIGHTS-OF-WAY OF RECORD.
 
SECTION TWO: It is further found that due to the immediate need of the affected property owner to record the plat, an emergency is declared to exist and this ordinance being necessary for the purpose of avoiding any further delay in construction permitting and finance finalization.
 
SECTION THREE: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the Deed Records of such office.
 
PASSED AND ADOPTED this 19th day of February, 2013.
