AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY R-1; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, PETITION FOR THE ANNEXATION OF CERTAIN LANDS TO THE CITY OF JONESBORO, ARKANSAS, HEREINAFTER DESCRIBED, WAS DULY FILED IN THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS ON MARCH 17, 1999; AND
WHEREAS, said petition for the annexation for said lands was duly signed by the sole owner of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 19, 1999, at which hearing it was found and declared that said petition for annexation was right and proper and that such lands hereinafter described shall be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexation dated April 19, 1999, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of May 26, 1999.
NOW, THEREFORE, BE IT ORDAINED and ENACTED by the City Council for the City of Jonesboro, Arkansas:
SECTION 1: The territories and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of April 19, 1999, be and are hereby accepted by the City of Jonesboro, Arkansas, said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The lands and territories are hereby annexed to and accepted by the City of Jonesboro, Arkansas, and more particular described as follows:
A part of the Northeast Quarter of the Northeast Quarter of Section 10, Township 13 North, Range 3 East, Craighead County, Arkansas, to wit: From the Northeast corner of said Section 10, run S 01º51'13" W along the East line of said Section 10 a distance of 323.05 feet to the point of beginning: then continue S 01º51'13" W along said East line a distance of 1001.08 feet to a point; thence leaving said East section line, run S 89º48'47" W a distance of 1306.75 feet to a point; thence N 01º16'46" E a distance of 1016.90 feet to a point; thence run N 89º31'00" E along city limit line a distance of 1146.64 feet to a point; thence leaving said city limit line run S 02º09'05" W a distance of 18.08 feet to a point; thence S 88º53'40" E a distance of 170.48 feet to the point of beginning, containing 30.63 acres, and being subject to a 30 foot right-of-way for Wimpy Lane along the West side of tract.
SECTION 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the City of Jonesboro.
SECTION 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning, water and sewage and other protection and benefit; that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist; this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
