AN ORDINANCE TO DELETE TITLE 2.56, PUBLIC WORKS DIRECTOR/CITY ENGINEER, TO AMEND TITLE 11.40, DEPARTMENT OF CODE ENFORCEMENT, AND TO DELETE TITLE 13.12, CITY PLANNER, OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS; AND FOR OTHER PURPOSES

WHEREAS, A.C.A. 14-42-110 grants the Mayor the power to appoint and remove all department heads unless overridden by vote of 2/3 of the entire council; and
WHEREAS, A.C.A. 14-43-504 (b) (1) states that the Mayor shall supervise the conduct of all the officers of the city; and
WHEREAS, A.C.A. 14-43-504 (a) states that the Mayor of the city shall be its chief executive officer; and
WHEREAS, the organization of the departments of city government are a proper function of the executive branch of that government; and
WHEREAS, designation of the duties and functions of each department and department head is a proper function of the chief executive;
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Jonesboro, that:
SECTION 1: That Title 2.56, Public Works Director/City Engineer, of the Code of Ordinances of the City of Jonesboro is hereby deleted in its entirety.
SECTION 2: That Title 11.40, Department of Code Enforcement, is hereby amended as follows:
Section 11.40.01, Creating Office, Section 11.40.02, Qualifications, and Section 11.40.03, Salary and renumeration, are hereby deleted in their entirety. The remaining sections of the title will be renumbered and appropriately, and will remain in effect as their purpose is to grant authority to enforce the various codes of this city.
SECTION 3: That Title 13.12, City Planner, of the Code of Ordinances of the City of Jonesboro is hereby deleted in its entirety.
SECTION 4: That the authority granted to and the duties required of the Mayor in the aforementioned Arkansas statutes are hereby affirmed; and the Mayor is directed to ensure that proper job descriptions are maintained for all department heads and employees of the City of Jonesboro.
