AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-89:1210 ON AUGUST 21, 1989)

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on February 5, 1986 and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on March 10, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated March 10, 1986, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas by its order of March 10, 1986.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of March 10, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part of parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Leonard McDaniel, Dale Reaves and others, Medallion Acres, off HWY 1B, 9.32 acres - Warren Dupwe)
Tract 1: A subdivision of a Fractional Part of the South Half Northwest Quarter, Section 32, Township 14 North, Range 4 East, more particularly described as follows: A subdivision described as Medallion Acres containing 17.58 acres more or less, further described as being Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29 and 30 of said Medallion Acres.
Tract II: A part of the South Half, NW Quarter, Section 32, T14N, R4E, Craighead County, Arkansas, bonded on the West By Medallion Acres Sub-division, bounded on the South and East by Lakewood Sub-division and Jonesboro City Water and Light water treatment site, more particularly described as follows: Beginning at the Southeast Corner of said Medallion Acres Sub-division as recorded in Book 123, Page 200 in the Circuit Court Clerk and Ex-Officio Recorder, Craighead County, Jonesboro, Arkansas, the point of beginning proper; thence East along the North boundary line of said Lakewood First, Second, and Third Addition, 969.47 feet; thence N 0° 45'W 418.80 feet; thence S 89° 15' W 969.50 feet to the East boundary line of said Medallion Acres Sub-division; thence S 0° 45' E 418.80 feet along with East boundary line of said Medallion Acres Sub-division to the point of beginning containing 9.32 acres.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-2).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning, and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
