CITY COUNCIL MINUTES - February 15, 2005

 

The Jonesboro City Council met Tuesday, February 15, 2005, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Doug Formon, City Clerk, Donna K. Jackson, City Attorney Phillip Crego, and eleven council members. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. Councilman Moore was unable to attend, and Councilman Province arrived at 6:40 p.m.

 

Councilman Farmer moved, seconded by Councilman Ashley to amend the minutes by deleting the words “evoking a moratorium” and replacing it with “delaying the matter until”, in the fourth paragraph. A voice vote was taken resulting in all members voting aye, with the exception of Councilman Province who had not arrived yet. Those members were: Farmer, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. Councilman Farmer moved, seconded by Councilman Perrin for the adoption of the minutes as amended from February 1, 2005. A voice vote was taken resulting in all members voting aye, with the exception of Councilman Province who had not arrived yet. Those members were: Farmer, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley.

 

City Attorney Crego provided the standard written legal report and stated no report was provided by APERMA, since the next trial date was for scheduled April. In Bingham vs. Jonesboro, a petition was filed with the Arkansas Supreme Court to review the decision rendered by the Court of Appeals.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE REPEALING ORDINANCE NO. 2461 WHICH CREATED PERMANENT MATA PLANNING AND IMPLEMENTATION COMMITTEES

 

Councilman Farmer moved, seconded by Councilman Street to suspend with the second and third readings of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. Councilman Street moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. Councilman Perrin moved, seconded by Councilman Farmer for the adoption of the emergency clause. A roll call vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The ordinance was assigned ordinance number 3521.

 

Councilman Perrin moved, seconded by Councilman Farmer for the adoption of a resolution naming judges, clerks, and alternate workers to serve in the election for directors for Position 1, 2, and 3 of the City Water and Light Plant improvement district. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The resolution was assigned number 2005:10.

 

Councilman Farmer moved, seconded by Councilman Street for the adoption of a resolution amending the Jonesboro Employee Handbook providing for a procedure for review of disciplinary decisions regarding department heads. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The resolution was assigned number 2005:11.

 

Councilman Farmer offered a resolution after amending the word “Before” to “About” in the title and findings portion of the resolution; and including the words “or part of” in the body of the resolution. Councilman Farmer moved, seconded by Councilman McCall for the adoption of the resolution as amended. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The resolution was assigned number 2005:12.

 

Under new business, Mayor Formon gave the state of the city address, thanking the citizens of Jonesboro, elected officials, and city staff for their help during his first six months in office. He spoke of continued growth for the City of Jonesboro citing the opening of Turtle Creek Mall, the closing of the Class IV landfill, and completion of Allen Park. Mayor Formon urged the Metropolitan Area Planning Commission to move quickly on matters of growth allowing Jonesboro the opportunity to thrive. Mayor Formon pledged continued support for parks and recreation, emergency services, and recognized a newly formed Street Crimes Unit.

 

Councilman Farmer moved, seconded by Councilman Dover to approve an ad hoc committee called the Ordinance Review Committee For Storm Water Phase II, appointing the following individuals:

 

Joe Little, residential contractor

Gene Vance, commercial contractor

Carlos Wood, Engineer

Bernie Auld, Engineer

Jerry Farris, ASU Environmental Services

Dennis Zolper, Attorney

Dewayne Beisner, Architect

Jon Wilbanks, citizen

Betty Shaw, citizen

 

Ex officio members:

Alec Farmer, Alderman

Claude Martin, City Engineer

Teddy Hooton, Street Superintendent

David Harris, City Planner

 

A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley.

 

Councilman Farmer moved, seconded by Councilman Perrin to suspend the rules placing the following two resolutions before the full council for consideration: Resolution to appoint members of the Parks and Recreation Citizen Advisory Committee and a Resolution to create and appoint members to an ad hoc Urban Forestry Committee. Both resolutions were amended by deleting the word “Ordained” and replacing it with the word “Resolved” in the enactment clause as well as deleting Section II of both resolutions.

 

Councilman Farmer moved, seconded by Councilman Perrin for the adoption (as amended) of the resolution to appoint members to an ad hoc Urban Forestry Committee. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The resolution was assigned number 2005:14.

 

Councilman Perrin moved, seconded by Councilwoman Williams for the adoption (as amended) of the resolution to appoint members of the Parks and Recreation Citizen Advisory Committee. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley. The resolution was assigned number 2005:15.

 

With no further business, Councilman Perrin moved, seconded by Councilman Ashley for adjournment. A voice vote was taken resulting in all members voting aye. Those members were: Farmer, Province, Hargis, Williams, Perrin, Street, Johnson, Dover, Furr, McCall and Ashley.
