CITY COUNCIL MINUTES - AUGUST 19, 1996

 

The Jonesboro City Council met Monday, August 19, 1996, at 6:30 p.m. A full quorum was in attendance. Present were: Hubert Brodell, Mayor; Donna K. Jackson, City Clerk; Phillip Crego, City Attorney; and 11 council members. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole.

 

The minutes of August 5, 1996, were approved as delivered by Councilman Harpole and seconded by Councilman Young. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO ADOPT A COMPREHENSIVE LAND USE PLAN AS RECOMMENDED BY THE METROPOLITAN AREA PLANNING COMMISSION

 

Councilman Harpole moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken with all eleven council members voting aye. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The ordinance was given the number 2713.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO CLOSE A PORTION OF GORDON STREET BEGINNING 140 FEET WEST OF INTERSECTION OF FOURTH STREET AND CONTINUING WEST UNTIL ITS INTERSECTION WITH MCCLURE STREET AND A PORTION OF WORD STREET BETWEEN FOURTH AND MCCLURE. (Arkansas Glass/Jon Coleman)

 

At the request of Attorney, Jon Coleman, Councilman Perrin moved, seconded by Councilman Kelton to table this item for two weeks. A voice vote was taken with all eleven council members voting aye. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole.

 

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Calvary Pentecostal /Kent Arnold)

 

Councilman Harpole moved, seconded by Councilman Perrin to suspend the rules and place on the third and final reading. A voice vote was taken with all council members voting aye, with the exception of Councilman Vance who voted nay. Those members voting aye were: Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken with all eleven council members voting aye. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The ordinance was given the number 2714.

 

The following ordinance was on the third and final reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Curtis Spence/ Real Estate Solutions)

 

Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken with all eleven council members voting aye. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The ordinance was given the number 2715.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Don Hudson)

 

No further action was taken regarding this ordinance.

 

Councilman Wise offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Skip Macon)

 

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on the third and final reading. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole.

 

The following ordinance was up for reconsideration to adopt the ordinance:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Herman George & Marion Perkins/ G. S. Brant Perkins)

 

Councilman Rega moved, seconded by Councilman Roddy for the reconsideration to adopt this ordinance. A roll call vote was taken resulting in a six to five vote in opposition to the motion for reconsideration. Those members voting aye were: Wise, Hannah, Young, Rega, and Roddy. Those members voting nay were: Vance, Province, Tate, Kelton, Perrin, and Harpole. Discussion was held regarding the proper procedure regarding reconsideration of an ordinance. With no set procedure in place it was determined the Council could do as it deems necessary.

 

Councilman Harpole moved, seconded by Councilman Perrin for the adoption of a resolution to condemn the following property locations: 412 north Drake, owner Jerrilyn Myers,

 422 West Woodrow, owner Danny Haney; 226 south bridge, owner Harold Wells. (His Extension which was granted for 90 days has expired) A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The resolution was given the number 1996:37.

 

Councilman Harpole moved, seconded by Councilman Perrin to set an Appeal Hearing regarding the Metropolitan Area Planning Commission’s denial of a replat for Mr. Leroy Richard’s property, located west of Keller’s Chapel Road as requested by Mixon & McCauley, P.A. for September 3, 1996, at 6:10 p.m. in Municipal Court. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole

 

The following bids were reviewed:

 

Bid No. 96:26 - Public Officials Liability Insurance - Only one bid of Authur Galagher & Company. Councilman Harpole moved, seconded by Councilman Kelton to accept low bid meeting bid specifications. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole

 

Bid No. 96:28 - Tech Park RR Spur - Councilman Young moved, seconded by Councilman Perrin to accept low bid meeting bid specifications. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole

 

Councilman Wise offered the following ordinance for the first reading:

 

ORDINANCE TO WAIVE BIDS FOR TWO (2) DEMO-FIRE TRUCKS AND TO APPROPRIATE $360,000 ($180,000 EACH) WITH $345,000.00 TO COME FROM THE FIRE TRUCK FUND AND THE BALANCE ($15,000) TO COME FROM UNAPPROPRIATED SALES TAX FUND. IN ADDITION $28,017 APPROPRIATED FROM UNAPPROPRIATED SALES TAX FUND FOR ADDITIONAL EQUIPMENT

 

Councilman Young moved, seconded by Councilman Wise to suspend the rules and place on the second reading. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. Councilman Harpole moved, seconded by Councilman Perrin to suspend the rules and place on the third and final reading. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. Councilman Kelton moved, seconded by Councilman Harpole for the adoption of the ordinance. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The ordinance was given the number 2716.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Nuckles & Son)

 

Councilman Tate moved, seconded by Councilman Roddy to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye, with the exception of Councilman Vance who voted nay. Those aldermen voting aye were: Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. Councilman Tate moved, seconded by Councilman Kelton to further suspend the rules and place on the third and final reading. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. Councilman Roddy moved, seconded by Councilman Tate for the adoption of the ordinance. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The ordinance was given the number 2717.

 

Councilman Roddy moved, seconded by Councilman Harpole for the adoption of a resolution approving report of Board of Commissioners of Southview Acres Street Improvement District No. 1. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Perrin, Roddy, and Harpole. The resolution was given the number 1996:38.

 

With no further business, the meeting was adjourned.
