MAPC MINUTES

JULY 13, 1978

 

The Metropolitan Area Planning Commission met Thursday, July 13, 1978, at 7:30 P.M. in the Court Room at City Hall.

 

The meeting was called to order by Mr. Chairman, Mr. Ralph Morrison.

 

Members Present: Morrison, Cooper, Ball, Smith, Tilton and Freeman

 

Members Absent: McDaniel, Brown and Morse.

 

Others Present: Mike Cameron, Roy Douglas, Brenda Barnes, Curt Hodges, Joe Tomlinson, Craighead County Judge Dennis Gilliam.

 

Minutes for June were read and approved. Items for business were as follows:

 

Item #1 George and Maxie Stem request a zoning of Residential Two (R-2) for a parcel of property abutting the present City limits of the City of Jonesboro. Subject zoning request is submitted under the provisions of Ordinance #1473 providing for zoning classifications prior to the subject property being annexed to the City. The MAPC is also asked to make a written statement as to what effect the proposed annexation of the property would have on the City accepting said lands. The property description is as follows: Begin at the Northwest corner of the Northwest Quarter of the Southwest Quarter of Section 27, Township 14 North, Range 4 East, thence south 1° 5’ west 641.0 feet to the point of beginning proper; thence 89° 46’ east 252.7 feet; thence south 280 feet; thence south 89° 48’ west 254.4 feet; thence north 1° 5’ east 280 feet to the point of beginning proper. The general description of this property is east of Richardson Road and adjacent to Kristal Drive.

 

Mr. Cooper made a motion to approve request, seconded by Mr. Tilton. REQUEST APPROVED UNANIMOUSLY.

 

A recommendation was made by Mr. Cooper and seconded by Mr. Freeman that the easement on the north side of Lot 9, Block D of Curtview Acres Subdivision be removed subject to a letter of approval from utility companies. RECOMMENDATION APPROVED UNANIMOUSLY.

 

Item #2 The following petitioners; Billy Joe Bailey, Rebecca Ann Bailey, Ernest J. Schroeder, Pearl M. Schroeder Edwin G. McAlister, Dora A McAlister, Billy Gene Nelson, Mary Jane Nelson, Michael Wayne Roleson, Diane Roleson, Lawrence Justice, Joan Justice, Charles Harris and Wava Jean Harris, request a zoning classification of Residential One, (R-1). Subject zoning request is submitted under the provisions of Ordinance #1473 providing for zoning classifications prior to the subject property being annexed to the City. The MAPC is asked to prepare a written statement as to what effect the said Annexation would have on the City accepting such lands. The property is described as follows:

Mr. Tilton made a motion to approve request, seconded by Mr. Freeman, subject to a dedication deed of 60’ right-of-way on Casey Springs Road. (30’on Bailey and Nelson property and 30’ on the Schroeder property.) REQUEST APPROVED UNANIMOUSLY.

 

Item #3 Pete Mead and Jimmy Mead Petitioners for Annexation request a zoning classification of Commercial Three (C-3) for the following described land. Subject zoning request is submitted under the provisions of Ordinance #1473 providing for zoning classifications prior to the subject property being annexed to the City. The MAPC is also asked to make a written statement as to what effect the proposed annexation of the property would have on the city accepting said lands. The property description is as follows:

 

A part of the North half of the northwest quarter of Section 32, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Northeast Corner of the Northwest Quarter of Section 32, Township 14 North, Range 4 East: thence west on the Section line 1215.77 feet to the point of beginning proper; thence continue west of the Section line 332.2 feet ; thence south 1° 12’ west 1311.36 feet to the south line of aforesaid North Half of the Northwest Quarter of Section 32; thence south 89° 57’ east on the 40 acre line 332.2 feet; thence north 1° 12’ east 1311.6 feet to the point of beginning proper, containing 10 acres. Subject to Parker Road, power line, gas easement and a 60 foot right-of-way by City Ordinance along and off the North side, Higginbottom Creek off the South side, sanitary sewer with easement for same and an underground telephone cable all as shown or indicated on plat. General description of this property is north of Higginbottom Creek and west of Browns Lane.

 

Mr. Cooper made a motion to approve request subject to a development plan being submitted in accordance with ordinance #21-14 and 21.15. Mr. Smith seconded motion. REQUEST APPROVED UNANIMOUSLY.

 

Item #4 F.N.P. Developers Inc. request a zoning classification of Residential One (R-1) for property abutting the City Limits of the City of Jonesboro. The zoning request is submitted under the provisions of City Ordinance #1473 providing for zoning classifications prior to subject property being annexed to the City. The MAPC is also asked to make written statement as to what effect the proposed annexation would have on the city accepting said lands. The description of the property is as follows: Lot 1 of S.E. Blalock Subdivision, less and except the East 300 feet thereof, and Lots 1 and 2 of a Replat and Re-Subdivision of Lots 2 & 3 of S.E. Blalock subdivision, less and except the south 125 feet of the west 255 feet of Lot 2 of said replat, containing 5.2 acres, more or less. The general location of this property is adjacent to Meadowlark Acres Subdivision and adjacent to Aggie Road. A motion was made by Mr. Ball and seconded by Mr. Smith to approve request subject to stipulation of 41’ right-of-way from centerline on Aggie Road. REQUEST APPROVED UNANIMOUSLY.

 

Item #5 Bruce Burrow requests a rezoning from Residential One (R-1) to Commercial three (C-3) the following described land: The North 600 feet of the West 300 feet containing 4.13 acres of the following described tract of land: The east 17 acres of the Northwest Quarter of the Southeast Quarter and the west 6 acres of the Northeast Quarter of the Southeast Quarter all being in Section 20, Township 14 North, Range 4 East, Craighead County, Arkansas, less and except the west 250 feet thereof. The general location of the property is west of Market Place Lane and east of Franklin Street.

 

Mr. Skip Mooney, Attorney for Bruce Burrow stated that he rezoning request from R-1 to C-3 would be the new home of McCarty Motor Co.

 

Mr. Bill Wade, Franklin Street resident spoke in behalf of a large group of residents of Franklin Street in opposition to the rezoning request. A letter of opposition from these residents is filed in the MAPC office.

 

Mr. Tilton made a motion to approve the request as submitted. Mr. Cooper seconded. A vote was taken. Voting aye: Tilton, voting no, Cooper, Ball, Smith and Freeman. REQUEST DENIED. Reason for denial being C-3 zoning not a proper zoning classification in the R-1 area.

 

Item #6 Guaranty Mortgage requests a Site Development Plan for Fairview Apartments. The development is located on Lot 1 of Replat of Lots 7-14 Block 1 of M.R. Carson Addition. The location is west of Ligget Street and east of Block Street.

 

Mr. Cooper made a motion to approve request subject to constructing a full width street according to City Ordinance from Aggie to the north side of South driveway and approved fire plug. Mr. Ball seconded request. REQUEST APPROVED UNANIMOUSLY.

 

Item #7 Jemco Construction Co. requests a preliminary approval of the Commercial property described as follows: All that part of the NW ¼ of the SW ¼ of Section 28, Township 14 North, Range 4 East, Lying East of Arkansas Highway No. 173 R/W, lying south of Race Street R/W, lying west of Gilmore Drive R/W, and containing 36.13 acres. The general location of this property is south of Race Street and east of Caraway Road.

 

A motion was made by Mr. Tilton and seconded by Mr. Cooper to approve request. REQUEST APPROVED UNANIMOUSLY.

 

Item #8 Ernest J. Schroeder requests a Final approval of Schroeder subdivision being described as follows: Parts of Lots 5 and 6 of Schroeder Subdivision of part of the Southeast Quarter of the Northwest Quarter of Section 26, Township 14 North, Range 3 east of the 5th Principal Meridian in Craighead County, Arkansas as shown on the recorded plat thereof, lying south of the proposed right-of-way of Arkansas Highway 226 and more particularly described as follows:

 

From the Southeast Corner of the SE ¼ of the NW ¼ said Section 26, the same being the Southeast corner of said Lot 6, the point of beginning; thence S 88° 28’ 48” W 758.49 feet along the quarter section line to a point, thence N 00° 27’ 30” W 427.08 feet to a point on the southerly right-of-way of said Highway 226, thence N 80° 07’ 13” E 322.58 feet along said right-of-way to appoint, thence in a northeasterly direction along said right-of-way along a curve whose radius is 716.18 feet a distance of 519.52 feet to a point on the east line of said SE ¼ of the NW ¼ said point bearing N 60° 26’ 18” E and being 509.36 feet distance form the previous point, thence S 00° 03’ 48” E 713.59 feet along the quarter section line to the point of beginning, containing some 8.971 acres, more or less. General location of this property is west of Rankin’s Oak Forest Addition and south of proposed Woodsprings Road. Mr. Freeman made a motion, seconded by Mr. Smith, to approve request. REQUEST APPROVED UNANIMOUSLY.

 

Item #9 Troy Sheets requests a final approval of a replat of the east 130 feet of Lots 3 and 4 of Dacus Acres. The general location of this property is west of Mitzi Land and east of Patrick Street. Mr. Cooper made a motion to approve request, seconded by Mr. Freeman. REQUEST APPROVED UNANIMOUSLY.

 

Item #10 Clay Kenward requests a final approval of a replat of Lots 4 and 5 into a single lot, Lot 4 of Turtle Creek Industrial Park. The general location of this property is north of Neil Drive and west of Turtle Creek. A motion was made by Mr. Freeman seconded by Mr. Smith to approve request. REQUEST APPROVED UNANIMOUSLY.

 

Item #11 Harvey Johnson requests a replat of Lots 1 thru 5 replat of Lot 1, Block D of Brairwood 6th Addition. The general location of this property is south of Tanglewood Drive and east of Loberg Lane. Mr. Cooper made a motion to approve request seconded by Mr. Tilton. REQUEST APPROVED UNANIMOUSLY.

 

Item #12 Guy Pardew request a preliminary approval of the 46 Unit Housing Project North of Northacres Subdivision more particularly described as follows: A part of the Northeast Quarter of Section 7, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows: commencing at the Southwest corner of said NE ¼ Section 7; thence north 88° 44; East along the center of said Section 7, a distance of 1537.07 feet; thence north 0° 32’ west 412.42 feet; thence south 88° 44’ west 436.2 feet; thence north 1° 16’ west 260.0 feet to the point of beginning proper; thence continue north 1° 16’ west 628.0 feet to an existing fence corner; thence north 88° 37’ east 607.8 feet; thence south 0° 32’ east 759.3 feet; thence south 88° 44’ west 236.9 feet; thence north 1° 16’ west 130 feet; thence south 88° west 362.5 feet to the point of beginning proper, containing 9.42 acres, more or less. Mr. Smith made a motion to approve request, seconded by Mr. Freeman. REQUEST APPROVED UNANIMOUSLY.
