The City Planning Committee met on Thursday, April 11, 1968 at 7:30 P.M. in the City Hall.
MEMBERS PRESENT: A.E. Scott (Chairman), Glen Lane, Clay Kenward, Bob Harrison, Marion Ulmer, Frank Falls, and Jack Jarrett.
OTHERS PRESENT: Brooks Griffith (representing the Public Works Department)
Chairman A.E. Scott declared minutes of the March 14, 1968 meeting approved as read with the following change to be made: Under Item 4, the first three lines should read, “Farmers Union, James O. Bridger, Lucy Cole, and L.N. Hynes, owners, requested a change of zoning from Residential (R-2 and R-3) to Commercial (C-3) of properties described as…”
Chairman announced that the meeting was open for public hearing on items that had been advertised for rezoning, and these items were presented in the following order:
Item #1. Fred Hankins to change the zoning from Residential (R-2) to Commercial (C-3) of a tract of land described as: a part of Lot 3 of Cobb and Lee’s Survey of the Northwest Quarter of Section 21, Township 14 North, Range 4 East, being more particularly described as follows: Beginning at the Southwest corner of aforesaid Lot 3; thence north 88 degrees 53’ East 25.0 feet to the east right of way line of Caraway Road to the point of beginning property; thence north 88 degrees 53’ east 202.0 feet thence north 210.0 feet thence south 88 degrees 53’ west 202.0 feet to the east right of way line of Caraway Road; thence south along said right of way line 210.0 feet to the point of beginning proper, containing 1.065 acres, and being subject to public road right of way off the south side thereof.
Item #2. Tony Bittle to change the zoning from Residential (R-1) to Commercial (C-3) of the North 212.4 feet of Lot 8 of Cobb and Lee Survey of the northwest quarter of Section 21, Township 14 North, Range 4 East, being a tract of land 212.4 feet by 395 feet.
Mr. Bill Penix appeared on behalf of the aforementioned parties and stated that assuming the rezoning of both properties was approved that a Sandy’s Hamburger restaurant would be constructed. He also stated that Mr. Ed Warmack is proposing to lease this property from Mr. Hankins and that there is a lease with Sandy’s subject to classification.
Chairman Scott then recognized citizens who wished to speak against the proposed rezoning of the Hankins property from Residential (R-2) to Commercial (C-3) and the Bittle Property from R-1 to C-3. Mr. Marshall Matthews, after having identified himself as a resident of 2310 Thaddeus Drive, Jonesboro Arkansas presented a petition to the Commission from residents and property owners who objected to the changes in classification of any of the property. The petition and its signers and their addresses read as follows:
“We undersigned residents and property owners in the area of Stallings Lane at Caraway Road hereby protest and object to efforts now being made to change classifications of any property at the intersection from residential to commercial; and we do hereby request and petition the City Council of the City of Jonesboro to deny such reclassification.

The above petitioners objected to any changes in classification on the grounds that adjacent residential property would be devaluated.
Following the public hearing and presentations by citizens, action on two items on the agenda and other business was as follows:
Mr. Fred Haywood of Fred Haywood and Associates, Civil Engineers and Surveyors of Jonesboro, Arkansas recommended to the Commission that they look into the problem of property owners selling property in the city limits of Jonesboro by the means of meats and bounds deed rather than having plat approval as set out in the city ordinances. After discussion, the Commission recommended to Charles M. Mooney, City Attorney, by means of a copy of the attached letter, the Commission’s interpretation of Subdivision ordinances 21-55 and 21-56 of the Ordinances of the City of Jonesboro with reference to this matter.
Following a review of the request for rezoning by Tony Bittle, it was moved by Jarrett, seconded by Ulmer, and carried that the commission approve a change in the zoning of the Bittle tract from Residential (R-1) to Commercial (C-3) to provide for a 30 foot right of way on Stallings Lane a d 41 foot right of way and 60 foot setback on Caraway Road, both right of ways and setback from the center line of Stallings Lane and Caraway Road. Lane abstained from voting. Eighteen month time limit to be added.
It was decided by the Commission that no action on the Hankins request to change in zoning from R-2 to C-3 would be made until the next regular meeting in May.
It was moved by Jarrett, seconded by Falls, and carried that the Commission would make all future recommendations without stating why such recommendations were made.
It was then moved by Ulmer, seconded by Jarrett, and carried that the Commission approve the replat of Lot 15 and the second replat of Block C of Marlo Acres First Addition to the City of Jonesboro.
There being no further business the meeting was adjourned.
