AN ORDINANCE TO ABANDON AND VACATE AN ALLEY LOCATED IN MEYER’S ADDITION TO THE CITY OF JONESBORO

WHEREAS, A petition was duly filed with the City Council of Jonesboro, Arkansas, on the 6th day of March, 1950, asking the City Council to vacate and abandon all that portion of the street designated on the plat of Meyer’s Addition to said city, now appearing of record in Deed Record Book 48, page 116, and designated on the plat of Gambill’s Addition to said City now appearing of record in Deed Record Book 23, page 610, and Deed Record Book 48, page 109, in the office of the record of deeds and Circuit Court Clerk for the Western District of Craighead County, Arkansas, said section of the street beginning at the Northeast corner of Lot 2 of the Northwest Addition to the City of Jonesboro, Arkansas, and ending at the North boundary line of Gambill’s Addition to the City of Jonesboro, Arkansas, and
WHEREAS, The petition also asks the City Council to vacate and abandon all that portion of the alley designated on the plate aforementioned, beginning at the Southwest corner of Lot 10, Block 1 of Meyer’s Addition and ending at the Southeast corner of Lot 10, Block 1 of Meyer’s Addition to the City of Jonesboro, and
WHEREAS, After due notices as required by law, the Council has at the time and place mentioned in the notice heard all person desiring to be heard on the question, and has ascertained that the section of street and the section of alley hereinbefore described has heretofore been dedicated to the public use as a street and as an alley herein described, has not actually been used by the public generally for a period of five years prior to the filing of the plat. That all of the property owners abutting upon the portion of the street and alley to be vacated have filed with the Council their written consent to such abandonment and that public interest and welfare will not be adversely affected by the abandonment of said street and alley.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1. The City Council of the City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the street and alley designated as follows:
STREET
Beginning at the Northeast corner of Lot 2 of the Northwest Addition to the City of Jonesboro, thence East approximately 29’ to a point where the line intersects with the west boundary line of Lot 10, Block One of Meyer’s Addition to the City of Jonesboro, thence South to the Southwest corner of Lot 10, Block One of Meyer’s Addition, thence South approximately 10 feet to a point where the line intersects with the North boundary line of Gambill’s Addition to the City of Jonesboro, thence North to the point of beginning proper.
ALLEY
Beginning at the Southwest corner of Lot 10, Block One of Meyer’s Addition to the City of Jonesboro, Arkansas, thence East approximately 279’ to the Southeast corner of Lot 10 Block One of Meyer’s Addition, thence South approximately 10 feet to a point where the line intersects with the North boundary of Gambill’s Addition to the City of Jonesboro, thence West along the North boundary of Gambill’s Addition to the City of Jonesboro approximately 279’ to a point due South of the Southwest corner of Lot 10, Block One of Meyer’s Addition, thence North approximately 10 feet to the Southwest corner of Lot 10, Block One of Meyer’s Addition, the point of beginning proper.
Said street and alley appear in Meyer’s Addition as shown in Deed Record 48, page 116, and Gambill’s Addition as shown in Deed Record 23, page 610, and Deed Record 48, Page 109, all of said records being in the office of the Circuit Court Clerk, Jonesboro, Arkansas.
SECTION 2. A copy of the ordinance, duly certified by the Clerk for the City of Jonesboro, shall be filed in the office of the recorder of the County, and recorded in the Deed Records of the County.
SECTION 3. This ordinance shall take effect and be in force from and after its passage.
ENACTED AND ORDAINED by the City Council for the City of Jonesboro, Arkansas, in regular meeting assembled at the City Hall in said City this 20th day of March, 1950.
