AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3 ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3) AND INDUSTRIAL (I-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, a petition for annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on March 14, 1996; and

 

WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 9, 1996, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty days having expired since the order of annexation dated April 9, 1996, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of March 27, 1997.

 

NOW, THEREFORE, BE IT ORDAINED AN ENACTED by the City Council of the City of Jonesboro, Arkansas:  

 

SECTION 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of April 9, 1996, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

SECTION 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

Part of the Southwest Quarter of the Southeast Quarter of Section 1, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:  Begin at the Northwest Corner of the Southeast Quarter of Section 1, Township 14 North, Range 4 East, Craighead County, Arkansas; thence South along the Half Section Line, 2155.30 feet to the point of beginning proper; thence East 233.70 feet; thence North 68o35'50" East 300.73 feet to the centerline of Bridger Creek; thence South 24o01'11" East, along said centerline, 208.14 feet to the North right of way line of United States Highway #49; thence in a Southwesterly direction along said right of way line along a 2.5964o curve to the right with a radius of 2206.91 feet, a distance of 633.88 feet; thence South 59o42"00" West 11.90 feet to aforesaid Half Section Line; thence North along said Half Section Line 316.90 feet to the point of beginning proper, containing 3.32 acres and being subject to a 30 foot easement for Clinton School Road along the West side of the tract, and a 25 foot easement for Bridger Creek along the East side of the tract;

 

Part of the Southwest Quarter of the Southeast Quarter of Section 1, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:  Begin at the Northwest Corner of the Southeast Quarter of Section 1, Township 14 North, Range 4 East, Craighead County, Arkansas; thence South along the Half Section Line 1534.60 feet to the centerline of Bridger Creek, the point of beginning proper; thence along said centerline as follows:  North 81o44'58" East 80.50 feet, South 57o23'00" East 59.40 feet, South 44o33'00" East 203.50 feet, South 23o01'00" East 123.30 feet, South 85o29'00" East 93.20 feet, South 24o01'11" East 245.94 feet; thence South 68o35'50" West 300.73 feet; thence North 208.70 feet; thence West 233.70 feet to the aforesaid Half Section Line; thence North along said Half Section Line 246.60 feet; thence East 130.00 feet; thence North 100.00 feet; thence West 130.00 feet to the aforesaid Half Section Line; thence North along said Half Section Line 65.40 feet to the point of beginning proper, containing 3.49 acres, and being subject to a 30 foot easement for Clinton School Road along the West side of the tract, and a 25 foot easement for Bridger Creek along the North and East sides of the tract.

 

SECTION 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.

 

SECTION 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Commercial (C-3) and Industrial (I-1) as shown on the attached Exhibit "A".

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory.  Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
