AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of Jonesboro, Arkansas:

 

SECTION 1: Ordinance No. 954 known as the zoning ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classifications as follows:

 

From Residential (R-2) to Commercial (C-3) the following described property:

 

LEGAL DESCRIPTION:

 

A part of the South Half of the Southeast Quarter of Section 17, Township 14 North, Range 4 East; being more particularly described as follows; begin at the Southwest Corner of the Southeast Quarter of said Section 17; thence North 00°00'00" East along the Quarter Section Line - 652.46' to a point on the North Right Of Way Line of Washington Avenue, the point of beginning proper; thence North 0°00'00" East along said Quarter Section Line- 173.11' to the South Right Of Way Line of the mainline of St. Louis Southwestern Railroad; thence South 60°04'26" East along said Right Of Way - 1130.69' to the P.C. of a curve to the Left, with a radius of 3487.75 and delta of 08°34'26"; thence Southeasterly along said curve - 521.91' to a point on the South Section Line of said Section 17; thence South 88°34'59" West along said Section Line - 350.49' to the North Right Of Way Line South 88°34'59" West along said Section Line - 350.49' to the North Right Of Way Line of Washington Avenue, said point being on a curve to the Right with a radius of 3637.78' and a delta of 03°28'37"; thence Northwesterly along said Right Of Way Curve - 220.76' to the pt of said curve; thence North 60°04'26" West along said Right Of Way - 1044.33' to the point of beginning proper, containing 5.01 acres more or less, subject to all Rights Of Way and easements of record.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract(s) of land described above in this ordinance is being delayed because of improper zoning, and that, therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
