AN ORDINANCE TO REQUIRE OWNERS OF SUBDIVISIONS IN THE CITY OF JONESBORO, ARKANSAS OR SUBDIVISIONS WISHING TO BE ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, TO PROVIDE STREET MARKERS ON ALL STREETS IN THE SUBDIVISION WHICH ARE BEING ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, to-wit:
Section 1: That the City Council of the City of Jonesboro, Arkansas has found that a great many streets are without street markers and that the lack of street markers in the City of Jonesboro, Arkansas are due to subdivisions being located within the City of Jonesboro and subdivisions being annexed to the City of Jonesboro, Arkansas, without requiring sub-dividers and/or owners of the land in question to provide for street markers.
Section 2: It shall be the duty of any property owners and/or sub-divider of lands wishing to be annexed to the City of Jonesboro, Arkansas, to provide for all street markers on all streets and at each corner of said streets before any land or lands shall be annexed to the City of Jonesboro, Arkansas.
Section 3: It shall be the duty of all property owners and/or sub-dividers of lands within the City of Jonesboro, Arkansas, from the date of passage of this ordinance, to provide for street markers on all streets and on each corner of said streets.
Section 4: All street markers which are required, as set out above, shall be constructed according to City specifications established by the City Engineers Office.
Section 5: All owners of property and/or sub-dividers of land, as set out above shall be required to provide street markers, according to specifications established by the City Engineers Office. The property owners and/or sub-dividers can provide street markers on an individual basis or the City of Jonesboro can provide street markers by agreement, to the individual property owner and/or sub-dividers, who shall then reimburse the City of Jonesboro for all labor and materials expended in the construction of required street markers.
Section 6: All words used in the singular shall be constructed in the plural and all words used in the plural shall be constructed in the singular.
Section 7: The provisions of this Ordinance are hereby declared to be severable and if any section, phrase, or provision shall for any reason be declared invalid, such declaration shall not affect the validity of the remainder of the section, phrase, or provision.
Section 8: All ordinances and or parts of ordinances in conflict herewith are hereby repealed.
Section 9: It is found and declared by the City Council that this Ordinance being necessary to insure adequate street markers, as well as uniformity of street markers within the City of Jonesboro, Arkansas, and that the City desires in the form of subdivisions shall have the required street markers at the proper locations; that, therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, this Ordinance shall take effect from and after its passage and approval.
