AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED MARCH 3, 1969; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4: DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on January 27, 1969, and
WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS. an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on March 3, 1969, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days have expires since the order of annexation dated March 3, 1969, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of April _3rd, 1969.
NOW THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order of March 3, 1969, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
A part of the Northeast Quarter of the Southeast Quarter , 8.41 acres; and a part of the Southeast Quarter of the Southeast Quarter 7.92 acres; all being in Section 23, Township 14 North of the Base Line, Range 3 East of the Fifth Principal Meridian, and being more particularly described as to follows: Beginning at a point on the East line of the Northeast Quarter of the Southeast Quarter of said Section 23 a distance of 775.22 feet South 1 degree 06’ West of the Northeast Corner of said Northeast Quarter of the Southeast Quarter; thence South 1 degree 06’ West along the East line of said Northeast Quarter of the Southeast Quarter and the Southeast Quarter of the Southeast Quarter of said Section 23 a distance of 1199.82 feet; thence North 89 degrees 09’ West 330.0 feet; thence North 1 degree 06’ East 265.74 feet; thence North 43 degrees 54’ West 35.35 feet; thence North 88 degrees 54’ West 114.56 feet; thence North 64 degrees 54” West 361.64 feet; thence North 26 degrees 06’ East 200.0 feet; then North 64 degrees 26’ West 7.26 feet; thence North 9 degrees 26’ East 378.50 feet; thence North 21 degrees 22’ East 196.21 feet; thence North 89 degrees 40’ East 597.04 feet to the point of beginning proper, and containing in all 16.33 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4, of the City of Jonesboro. Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro. Arkansas, that there is not an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the city’s next census court; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage.
PASSED and ADOPTED this 5th day of May, 1969.
