AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on July 30. 1985; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on September 3, 1985, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated September 3, 1985, and no proceedings to prevent said annexation having been filed in the Circuit Court of the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of October 7, 1985.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of September 3, 1985, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Sirois 2nd Sub-division Don West Property - 63 Bypass and Highway 1B - Skip Mooney)
TRACT I: A part of the Northeast Quarter of Section 31, Township 14 North, Range 4 East, and a part of the Northwest Quarter of Section 32, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Northeast corner of said Section 31; thence South 0°17’ West on the Section line 1048.2 feet to the point of beginning proper; thence South 58°06’ East 473.6 feet:
Thence South 35°49’ West 205.5 feet; thence North 76°07’ West 283.2 feet; thence North 76°32’ West 148.4 feet; thence South 70°12’ West 81.5 feet to the easterly right-of-way line of Arkansas Highway N0.1; thence North 47°19’ West along said right-of-way 54.0 feet; thence North 48°08’ West along said right-of-way 240.0 feet; thence South 41°52’ West along said right-of-way 5.0 feet; thence 45°07’ West along said right-of-way 68.8feet thence North 41°17’ West along said right-of-way 50.0 feet; thence North 37°18’ West along said right-of-way 50.0 feet; thence North 33°44’ West along said right-of-way 50.0 feet; thence North 28°26’ West along said right-of-way 50.0 feet; thence North 24°28’ West along said right-of-way 50.0 feet; thence North 20°51’ West along said right-of-way 50.0 feet; thence North 17°37’ West along said right-of-way 50.0 feet thence North 13°23’ West along said right-of-way 50.0 feet; thence North 9°30’ West along said right-of-way 50.0 feet; thence North 5°41’ West along said right-of-way 50.0 feet; thence North 1°41’ West along said right-of-way 50.0 thence North 0°11’ East along said right-of-way 90.5 feet; thence South 49°43’ East 351.2 feet; thence South 58°06’ East 490.9 feet to the point of beginning proper, containing 8.65 acres; and also described as Sirois 2nd Addition to Jonesboro, Arkansas;
TRACT II: A part of the Northeast Quarter of the Northeast Quarter of Section 31, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Northeast of Section 31, Township 14 North, Range 4 East, Thence South 0°17’ East on the Section line 83.0 feet to the South right-of-way line of U.S. Highway No. 63 Bypass, the point of beginning proper; thence South 0°17’ East 965.2 feet to the centerline of Higginbottom Creek; thence with the meanderings with said centerline as follows: North 58°06’ West 490.9 feet; North 49°43’ West 38.3 feet to the Easterly right-of-way line of U.S. Highway No.63 Bypass; thence with meanderings with said right-of-way line as follows: North 43°54’ East 75.8 feet; North 43°29’ East 75.8 feet; North 43°29’ East 139.8 feet; North 24°45’ East 116.1 feet; North 17°20’ East 292.4 feet; North 39°00’ East 86.2 feet; North 50°47’ East 85.2 feet; North 66°58’ East 50.0 feet to the point of beginning proper, containing 5.14 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1) for Tract 1 and Commercial (C-3) for Tract II.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is not an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
