AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES

WHEREAS, it is in the best interest of the owner of the property, the residents of the City of Jonesboro and all interested parties that the property described below be rezoned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas:
SECTION 1: Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro, Arkansas, shall be amended as recommended by the Metropolitan Area Planning Commission (MAPC). Such recommendation of the MAPC changes the zoning classifications from Residential (R-1) to Residential (R-3), certain real property situated in Jonesboro, Craighead County, Arkansas, which is more particularly described as follows:
The South Half of the Southeast Quarter of Section 32, Township 14 North, Range 4 East, more particularly described as follows: Begin at the Southwest corner of the South Half of the Southeast Quarter; thence N 0`32'46" E 1309.72 feet; thence N 89`40'39" E 2617.21 feet to the West right-of-way of Caraway Road; thence with the meanderings of said right-of-way; thence S 0`48'59" E 23.36 feet; thence S 02`02'45" W 300.0 feet; thence S 13`21'21" W 25.5 feet; thence S 02`02'45" W 75.0 feet; thence S 00`49' E 100.12 feet; thence S 02`02'45" E 183.87 feet; thence S 00`12'10" W 608.69 feet to the South line of Section 32, thence S 89`48'13" W 2603.43 feet to the point of beginning, containing 78.49 acres, more or less, subject to all rights of way and easements of record.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the rezoning of the aforementioned real property is necessary to maximize the property's best use and that such use is being delayed due to the improper zoning. Therefore, the City Council further finds and declares that an emergency exists and this ordinance, being necessary for the preservation of public peach, health and safety, shall take effect and be in full force and effect from and after its passage and approval.
