A RESOLUTION TO CONVEY A PORTION OF ALLEN PARK TO THE CITY WATER AND LIGHT PLANT OF JONESBORO

WHEREAS, the City of Jonesboro is the owner of part of the SW1/4 of the SW1/4 of Section 27, T14 North - R4 East, more commonly known as Allen Park (Tract 3)
WHEREAS, the City of Jonesboro currently maintains the property and playground equipment at Allen Park (Tract 3)
WHEREAS, City, Water and Light would like to purchase part of the SW1/4 of the SW1/4 of Section 27, T14N-R4E more particularly described as follows;
Begin at the SE corner of lot 7 in block "C" of Curtview Addition to the City of Jonesboro, Arkansas as shown in plat book 158 page 88; thence north 01°42'52" E along the east side of said block "C", Curtview Addition 227.81'; thence S89°18'51"E 221.16'; thence S01°42'52"W 227.81' to the north line of block "C" of the East Park Subdivision as shown in plat cabinet B envelope 130; thence N89°18'51"W (rec. N89°39'36"W) 221.16' to the point of beginning, containing 1.16 acres, more or less.
WHEREAS, the City of Jonesboro shall be permitted to install, maintain and own playground equipment in the park.
WHEREAS, the City of Jonesboro shall continue to maintain the property as a City Park.
NOW, THEREFORE BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION 1: That the City of Jonesboro shall convey part of the SW1/4 of the SW1/4 of Section 27, Township 14 North, Range 4 East, to The City Water and Light Plant of Jonesboro.
SECTION 2: That the conveyance of this property be subject to the property being forever used as part of a 100' radius well setback for a City, Water and Light well and if the property is not so used as a well setback that said property shall revert to the City of Jonesboro.
SECTION 3: The Mayor, Doug Formon and City Clerk, Donna Jackson are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate the conveyance of this property.
