CITY COUNCIL MEETING OCTOBER 18, 1976

 

The Jonesboro City Council met in regular session, Monday, October 18, at 7:30 p.m. There were present: Mayor, City Clerk, City Attorney, and the following named aldermen: Bowers, Sanderson, Bridger, Burns, Stricklin, Minx, Smith, Hinson, Haggenmacher, Johnson and Darling. Absent: Hannah.

 

After some discussion with Carrol Lowe, Parks Director, Mr. Johnson moved that a gate be placed at the entrance of Craighead Forest to be locked from 12 p.m. until 6:00 a.m. Motion was seconded by Mr. Darling and received unanimous vote of council.

 

Mr. Smith moved that the City Attorney research the Ark. State Statute 19-3615 through 19-3630, and also the City Ordinance creating the Parks Commission and bring same in compliance with State Law, seconded by Mr. Burns. All voted aye.

 

The Mayor set October 28, at 5:00 p.m. for a council meeting for the purpose of hearing proposed projects of CDBG, and November 4, at 5:00 as a public hearing concerning the same matter.

 

Mr. Bowers offered the following ordinance: (Rezoning)

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES

 

Mr. Haggenmacher moved that the ordinance be placed on second reading, seconded by Mr. Smith, all voted aye.

 

The Mayor issued a Proclamation that Halloween be celebrated on Saturday, October 30th instead of Sunday, October 31st, and Mr. Hinson moved that the proclamation be accepted, seconded by Mr. Bridger. Roll call voting aye: Bowers, Bridger, Burns, Stricklin, Minx, Smith, Hinson and Johnson. Voting nay, Mr. Darling and Haggenmacher passed.

 

Mr. Bowers offered the following ordinance:

 

AN ORDINANCE TO AMEND SECTION 2-103 OF THE CODE OF ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, CREATING THE MEMBERSHIP FOR ADVERTISING & PROMOTION COMMISSION

 

Mr. Minx moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Stricklin, all voted aye. After the ordinance had been read, Mr. Darling moved that the ordinance be placed on 3rd and final reading, seconded by Mr. Minx, all voted aye. Mr. Minx moved for the adoption of the ordinance, seconded by Mr. Stricklin, all voted aye and the ordinance was given #1539.

 

The Mayor appointed Mr. Minx and Mr. Burns to serve on the Advertising and Promotion Commission and Mr. Stricklin moved for the acceptance of same, seconded by Mr. Bowers, with all voting aye except Mr. Burns and Mr. Minx who passed.

 

The following ordinance was on 3rd reading: (Annex Edwards Subdivision)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED AUGUST 8, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3, ZONING SAID ANNEXED TERRITORY R-3; DECLARING AND EMERGENCY; AND FOR OTHER PURPOSES

 

Mr. Johnson moved for the adoption of the ordinance, seconded by Mr. Bowers, all voted aye and the ordinance was given #1540.

 

Mr. Johnson offered the following ordinance: (Traffic Control North School)

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES; TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF; AND FOR OTHER PURPOSES

 

Mr. Johnson moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Darling, all aye. Mr. Johnson moved that the rules be further suspended and the ordinance be placed on 3rd and final reading, seconded by Mr. Haggenmacher, all voted aye. After the ordinance to include the emergency clause, seconded by Mr. Hinson, all voted and the ordinance was given #1541.

 

The following ordinance was on 3rd reading: (Traffic Control Hurricane Drive)

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF AND FOR OTHER PURPOSES

 

Mr. Bowers moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Sanderson, all voted aye and the ordinance was given #1542.

 

The following ordinance was on 3rd reading: (Amend Rezoning form 6 to 12)

 

AN ORDINANCE TO AMEND ORDINANCE NO. 1196, SECTION 24-31 OF THE CODE OF ORDINANCES BY PROVIDING FOR AMENDMENTS TO THE REGULATIONS AND/OR BOUNDARIES OF ZONING DISTRICTS WITHIN THE CITY OF JONESBORO                     

 

Mr. Darling moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Bowers, all voted aye and the ordinance was given #1543.

 

The following bid was opened on uniforms for the Fire Department:

 

Southern Uniforms                     $2,594.90

 

Mr. Burns moved that the bid be accepted, seconded by Mr. Bridger, all voted aye except Mr. Sanderson who cast a negative vote.

 

The following bids were opened on a 1968 Ford Truck:

 

Ray Payton                     $147.00

Jeff Townsand                     145.00

Carroll Carr                     103.00

 

Mr. Darling moved that the vehicle be sold to the highest bidder, Mr. Ray Payton, seconded by Mr. Bowers, with the only descending vote cast by Mr. Haggenmacher.

 

Mr. Smith moved that the City be authorized to ask for cleaning bids, seconded by Mr. Darling, all voted aye.

 

Mr. Sanderson offered the following resolution, and Mr. Smith moved for the adoption of same, seconded by Mr. Darling, all voted aye. The resolution was given the number 1976:18.

 

RESOLUTION TO LEVY A 1 MILL TAX ON ALL REAL AND PERSONAL PROPERTY FOR THE FIREMEN’S PENSION AND RELIEF FUND

                     

Mr. Sanderson offered the following resolution, and Mr. Sanderson moved for the adoption of same, seconded by Mr. Bowers, all voted aye. The resolution was given the number 1976:19.

 

RESOLUTION TO LEVY A 5 MILL TAX ON ALL REAL AND PERSONAL PROPERTY IN ORDER TO CARRY ON THE GOVERNMENT OF THE CITY OF JONESBORO

 

Mr. Sanderson offered the following resolution, and moved for the adoption of same, seconded by Mr. Bowers, all voted aye. The resolution was given the number 1976:20.

 

RESOLUTION TO LEVY A 1 MILL TAX ON ALL REAL AND PERSONAL PROPERTY FOR THE CITY LIBRARY TAX

 

Mr. Sanderson offered the following resolution, and Mr. Stricklin moved for the adoption, seconded by Mr. Sanderson. The resolution was given the number 1976:21.

 

RESOLUTION TO LEVY A 1 MILL TAX ON ALL REAL AND PERSONAL PROPERTY FOR THE POLICEMAN’S PENSION AND RELIEF FUND

 

Mr. Darling moved that the City Attorney be asked to draw an ordinance placing “No Parking” on the south side of College from Main Street, west past Hurricane Drive. The motion was seconded by Mr. Johnson with unanimous vote of the council.

 

After the Mayor had read to council recommendations from the Parking Authority, Mr. Minx suggested that these recommendations be turned over to the Parking Committee of Council.

 

Mr. Minx moved that permission be granted to place a mobile home at 422 N. Main, seconded by Mr. Haggenmacher, all voted aye.

 

Mr. Stricklin gave recommendations from the Fire and Police Committee as follows:

 

1. Policemen to be paid $10 daily for court appearances

2. Regular hourly rate to be paid for off duty work, retroactive to September 1, 1976.

 

He moved that these recommendations be accepted, seconded by Mr. Burns, with unanimous vote of council.

 

There being no further business, council adjourned.
