AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL R-1; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on May 31, 1978; and
WHEREAS, said Petition for the annexation of said lands was duly signed by the sole owners of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and hearing of said Petition was duly had and held in the County Court of Craighead County, Arkansas on July 7, 1978, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas whereupon an Order for annexation was made and entered, and
WHEREAS, thirty days having expired since the Order of annexation dated July 7, 1978, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory in said lands annexed to the City of Jonesboro Order of the County Court of Craighead County, Arkansas, by its order of July 7, 1978, be and are hereby accepted by the City of Jonesboro, Arkansas and said territory hereinafter described shall be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing herein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
Lot 1 of SE Blaylock Subdivision, less and except the East 300 feet thereof, and Lots 1 and 2 of a Re-plat and Re-Subdivision of Lots 2 & 3 of SE Blaylock Sub-division, less and except the South 125 feet of the West 255 feet of Lot 2 of said Re-Plat, containing 5.2 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 3 of the City of Jonesboro.
Section 4: The said lands and territory annexed to the City of Jonesboro are hereby zoned residential R-1.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection benefits and that said benefits and protection are urgently needed in order to allow orderly growth and development of said lands and territory, therefore , an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passes.
