AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY R-1 AND C-3; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on November 12, 1976; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on December 20, 1976, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days having expired since the order of annexation dated December 20, 1976, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of December 20, 1976, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory herein after described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
A part of the Northwest Quarter Northwest Quarter (9.83 acres), a part of the Southwest Quarter Northwest Quarter (18.25 acres), Section 25, a part of the Northeast Quarter Northeast Quarter (2.10 acres), a part of the Southeast Quarter Northeast Quarter (1.50 acres), Section 26, all being in Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Beginning at the Southeast Corner of the NW ¼ NW ¼, Section 25, aforesaid; thence South 1°23’ West along the East line of the SW ¼ NW ¼ Section 25, a distance of 666.7 feet; thence South 89°40’ West along the South line said SW ¼ NW ¼ 903.1 feet to the Northeasterly right-of-way line of Highway 63 Bypass; thence North 48° 54’ 30” West along said right-of-way line 1002.4 feet; thence North 16° 30’ West along said right-of way line 115.3 feet; thence North 60°10’ East along the Southeasterly right-of-way line of Wood Springs Road 466.4 feet; thence continue along the South right-of-way line of Wood Springs Road as follows: North 87°28’ East 590.44 feet, Northeasterly 88.76 feet along the arc of a 14.309°curve to the left, North 74°46’ East 84.6 feet, Northeasterly 232.42 feet along the arc of a 13.429° curve to the left; thence South 24°48’ 45” East 489.9 feet; thence north 65° 21’ East along the route of an existing Sanitary Sewer 146.0 feet to the center of an existing Sanitary Sewer manhole; thence along said East line 103.9 feet to the point of beginning proper and containing 31.68 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro and hereby zoned Residential (R-1) are particularly described as follows:
A part of the Northwest Quarter Northwest Quarter (0.06 acres), a part of the Southwest Quarter Northwest Quarter (7.06 acres), all being in Section 25, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Beginning at the Southeast Corner of the NW ¼ NW ¼, Section 25, aforesaid, thence South 1°23’ West along the East line of the Southwest Quarter Northwest Quarter Section 25, a distance of 666.7 feet; thence South 89° 40’ West along the South line said SW ¼ NW ¼ 605.03 feet to the center of Christian Creek; thence along the center of Christian Creek as follows; North 13°04’ East 195.7 feet, North 64°55’ East 123.6 feet, North 33°22’ West 144.0 feet, North 45°23’ East 124.8 feet, North 12°55’ East 94.2feet, South 88°21’ East 113.2 feet, North 30°43’ East 100.0 feet, North 75°56’ East 91.4 feet, South 71°55’ East 137.3 feet, North 14°15’ East 69.3 feet, North 8°10’ West 59.7 feet, North 72°08’ East 47.5 feet to the East line of the NW ¼ NW ¼ Section 25; thence South 1°52’ West along said East line 75.9 feet to the point of beginning proper and containing 7.12 acres, more or less.
Said lands and territory annexed to the City of Jonesboro and hereby zoned Commercial (C-3) are particularly described as follows:
A part of the Northwest Quarter Northwest Quarter (9.77 acres), a part of the Southwest Quarter Northwest Quarter (11.19 acres), Section 25, a part of the Northeast Quarter Northeast Quarter (2.10 acres) a part of the Southeast Quarter Northeast Quarter (1.50 acres), Section 26, all being in township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Southeast Corner of the NW ¼ NW ¼ Section 25, aforesaid; thence South 1°23’ West along the East line of the SW ¼ NW ¼ , Section 25, a distance of 666.7 feet; thence South 89°40’ West along the South line said SW ¼ NW ¼ 605.3 feet to the Center of Christian Creek and the point of beginning proper; thence continue South 89°40’ West 297.8 feet to the Northeasterly right-of-way line of Highway 63 Bypass; thence North 48° 54’30” West along said right-of-way line 1002.4 feet; thence North 16°30’ West along said right-of-way line 115.3 feet; thence North 60°10’ East along the Southeasterly right-of-way line of Wood Strings Road 466.4 feet; thence continue along the South right-of-way line of Wood Springs road as follows: North 87°28’ East 590.44 feet, Northeasterly 88.76 feet along the arc of a 14.309° curve to the left, North 74°46’ East 84.6 feet, Northeasterly 232.42 feet along the arc of a 13.429° curve to the left; thence South 24°48’45” East 489.9 feet; thence North 65°21’ East along the route of an existing Sanitary Sewer 146.0 feet to the center of an existing Sanitary Sewer Manhole; thence South 27°49’ East 24.9 feet to the East line of the NW ¼ NW ¼, aforesaid; thence South 1°52’ West along said East line 28.0 feet to the center of Christian Creek; thence along the center of Christian Creek as follows: South 72°08’ West 47.5 feet, South 8°10’ East 59.7 feet, South 14°15’ West 69.3 feet, North 71°55’ West 137.3 feet, South 75°56’ West 91.4 feet, South 30°43’ West 100.0 feet, North 88°21’ West 113.2 feet, South 12°55’ West 94.2 feet, South 45°23’ West 124.8 feet, South 33°22’ East 144.0 feet, South 64°55’ West 123.6 feet, South 13°04’ West 195.7 feet to the point of beginning proper and containing 24.56 acres, more of less.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
