AN ORDINANCE TO AMEND ORDINANCE NO. 2206, SECTION 11.20.11 (1) LOCAL EXCEPTIONS TO THE NATIONAL ELECTRICAL CODE, TO EXEMPT MANUFACTURED HOMES CONVERTED INTO COMMERCIAL OFFICE SPACE, PRE-BUILT (OFF SITE) PORTABLE OFFICE BUILDINGS AND ANY TYPE SIX (VI) NON-COMMERCIAL ACCESSORY BUILDINGS FROM THE CITY OF JONESBORO REQUIREMENT TO BE WIRED IN CONDUIT, AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas.
SECTION 1: That Section 11.20.11 of the Code of Ordinances of the City of Jonesboro is hereby amended to read as follows:
(1) With the exception of the following exemptions, all commercial buildings shall be wired in metal conduit. Metal conduit being defined as (a) rigid conduit, (b) intermediate conduit, (c) E. M. T. electrical metallic tubing.
(A) A manufactured home being converted for use as a commercial office shall be exempt from the City of Jonesboro requirements to be wired in metal conduit, when said structure shall be occupied on a temporary basis, with temporary being defined as a limited time not to exceed twelve (12) months. Under extenuating circumstances, an appeal for extension of time can be made to the City Council for approval.
(B) Pre-built (off site) portable office buildings, not exceeding 500 square feet shall be exempt from the City of Jonesboro requirements to be wired in metal conduit, when said structure shall be occupied on a temporary basis, with temporary being defined as a limited time not to exceed twelve (12 ) months. Under extenuating circumstances, and appeal for extension of time can be made to the City Council for approval can be made to the City Council for approval.
(C) Any type six (wood frame) non-commercial accessory buildings to a residential use shall be exempt from the City of Jonesboro requirements to be wired in metal conduit.
SECTION 2: If for any reason any portion of this ordinance is held to be invalid, such invalidity shall in no way effect the remaining portions thereof which are valid, but such valid portions shall remain in full force and effect.
SECTION 3: It is found and declared by the City Council that an emergency exists and this ordinance being necessary for the preservation of the public peace, health, and safety, shall take effect from and after its passage and approval.
