The minutes of the January 13, 2004 meeting were approved as prepared on a motion by Gott, second by Damron and unanimous vote.
#1 CU04-1 Charles Martin and Cloyce Carter requested approval of a conditional use for placement of a manufactured home, residential style, in the R-1, Single Family Medium Density District. The address of the property is 2005 Prescott Lane and the general location of the property is on the west side of Prescott Lane, south of Magnolia Road.
No opposition was expressed by any in attendance.
Glenn Batten, City Planner, stated that this is similar to placement of a hardship manufactured home to help with a medical hardship; however, those permits are issued for one year and is renewable for a second year and then they have to be removed. Mr. Martin is the grandson of Floyd Prescott and he wants to place the home there permanently. Mr. Batten recommended approval of the conditional use stating that the residential style manufactured home is consistent with the other uses in the area. Mr. Batten further recommended that prior to placement of the home that the building inspector inspect the home for compliance with the zoning ordinance and inspect the foundation prior to placement and obtain utility inspections prior to occupancy.
Mr. Vance made a motion to approve the request with the following stipulations:
1. The owner shall get with the building inspector to inspect and approve the manufactured home for compliance with the zoning ordinance prior to being moved on the lot
2. The owner shall have the foundation inspected prior to placement of the home
3. The owner shall obtain utility inspections prior to occupancy
The motion was seconded by Mr. Damron. Voting was 5 in favor, 0 opposed. Those voting aye were Vance, Day, Moore, Damron, Gott. MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.
#2 PP04-6 Vance Brown requested preliminary approval of Brownstone Phase II containing 17 lots on 5.69 acres. The general location of the property is on the west side of Harrisburg Road, south of Brownstone Drive.
WITHDRAWN BY JOHN EASLEY, PROJECT ENGINEER, PRIOR TO A MOTION BEING MADE.
#3 Discussion of the River Oaks Subdivision located on the north side of Craighead Forest Road, west of Harrisburg Road.
It was pointed out that there were apparently conflicting ordinances regarding the right of way required for the classifications of streets in Jonesboro. Glenn Batten, City Planner, stated that there is confusion surrounding the three or four ordinances in place that needs to be cleared up. The MATA ordinance amended Section 9 of the Code of Ordinances and the Subdivision Regulations are contained in Section 15. The conflicts for right of way for a collector street vary from 60’ to 70’ to 80’. Mr. Vance explained that he was on the council at the time the MATA street standards were adopted in 1995. Mr. Vance stated that while some of the standards need to be revisited, that it was the city council’s intent at the time to adopt this book of standards for use with subdivision development as well as the designated streets to be improved under MATA. Claude Martin, City Engineer, stated the he was employed by the city just before the adoption of these standards and this is what his office has used for years to review plans and to construct streets. It was determined by the MAPC that the street standards contained in the MATA book are what is in effect at this time.
With regard to River Oaks Subdivision, Mr. Abel stated that although 30’ of right of way is all that is required for Craighead Forest Road, he is still going to dedicate 35’ of right of way to facilitate future widening.
