ORDINANCE AMENDING SECTION 5.16.18 OF THE JONESBORO MUNICIPAL CODE TO REQUIRE THE PAYMENT OF ADMINISTRATIVE FEES IN CONNECTION WITH SERVICES PROVIDED BY THE CITY IN CONNECTION WITH THE CORRECTION OF ENVIRONMENT DEFICIENCIES AS DESCRIBED IN SECTION 5.16.16 OF THE MUNICIPAL CODE

WHEREAS, Section 5.16.16 of the Jonesboro Municipal Code makes it unlawful for a property owner to allow weeds to grow higher than twelve (12) inches or to become unsightly or unsanitary or to allow garbage, rubbish, rotting or dead limbs or trees and other unsafe, unsightly or unsanitary articles and things to accumulate on such real property.

 

WHEREAS, Section 5.16.17 of the Jonesboro Municipal Code authorizes the Code Enforcement Officer to remove and correct such unsafe, unsanitary or unsightly condition or condemned structure.  The cost and expense incurred in removing and correcting said conditions is authorized as a lien upon the property.

 

WHEREAS, the City incurs significant administrative costs in addition to the actual cost of removal and correction activities.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas

 

That Section 5.16.18 of the Jonesboro Municipal Code be amended as follows:

                     

The Code Enforcement Officer, acting on behalf of the City of Jonesboro, is authorized to assess a property a fee of One Hundred Dollars ($100.00) to cover the cost of administering the removal and correction of conditions described in Section 5.16.17. of the Municipal Code.  This fee shall be in addition to the actual cost of the work involved in correcting the conditions and is to be in addition to any fines imposed by the District Court.

 

Due to the immediate need to recover costs associated with these code enforcement activities, an emergency is declared to exist and this Ordinance being necessary for the preservation of public health and safety, shall take effect from and after its passage and approval.
