AN ORDINANCE AUTHORIZING SALE OF A PORTION OF CITY PROPERTY TO THE ARKANSAS STATE  HIGHWAY COMMISSION FOR  RIGHT-OF-WAY PURPOSES

WHEREAS,  the City is the owner of certain properties at the corner of Wood Street and the Highway 63 Bypass, on which is located Fire Station No. 5; and
 
WHEREAS,  the Arkansas State Highway Commission is desirous of securing right-of-way  for construction of  improvements on the  Highway 63  Bypass and has offered to purchase  0.02  acre  from  the  City  for  that  purpose;  and
 
WHEREAS, the Arkansas State Highway Commission has agreed to pay to the City the sum of One Thousand Three Hundred Fifty Dollars ($1,350.00) for said property.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: That the City sell to the Arkansas State Highway Commission, the following described real property located in Craighead County, Arkansas, to-wit:
 
A part of the Southeast Quarter of the Southeast Quarter   of the Southwest Quarter of Section 25, Township 14 North, Range 3  East,  Craighead County,  Arkansas,  more particularly described as follows: Starting at the Northwest Corner of the Southeast Quarter of the Southwest Quarter of Section 25; thence North 89° 29' East along the North line of said Southeast Quarter of the Southwest Quarter of Section 25 a distance of  715.34 feet to a point on the existing Southerly right-of-way line of U. S. Highway 63 Bypass; thence South 79° 35' 43" East along said existing  right-of-way  line  a  distance of 65.31 feet to a point on the proposed Southerly right-of-way line of said U. S. Highway 63 Bypass for the point of beginning; thence continue South 79° 35' 43" East along said existing right-of-way line a distance of 61.77 feet to a point; thence South 54° 45' East along said existing right-of-way line a distance of 22.8 feet to a point; thence South 14°24' 12" West a distance of 22.56 feet to a point on said proposed Southerly right-of-way line of U.S. Highway 63 Bypass; thence North 43°04' 36" West along said proposed right-of-way line a distance of 35.11 feet to a point; thence North 67°36' 01" West along said  proposed  right-of-way line a distance of 53.86 feet to the point of beginning and containing  0.02 acre, more or less, for the sum of One Thousand Three Hundred Fifty Dollars ($1,350.00) for use by the State as right-of-way for construction on the Highway 63 Bypass.
 
SECTION 2: That the Mayor and City Clerk are hereby authorized and directed to execute any and all papers necessary to transfer said property to the State.
 
SECTION 3: It is found and declared by the City Council that an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety. it shall take effect from and after its passage and approval.
