AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter more fully described, was duly filed in the County Court of Craighead County, Arkansas on May 20, 1985; and,

 

WHEREAS, said petition for the annexation of the land was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and,

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the Quorum Court of Craighead County, Arkansas, on June 24, 1985 at 7:00 o’clock p.m., at which hearing it was duly found and declared that the petition for annexation was right and proper and that the lands hereinafter more fully described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,

 

WHEREAS, thirty (30) days have expired since the order of annexation was filed on June 28, 1985 and no proceedings to prevent the annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, the annexation proceedings were in all things confirmed by the Quorum Court of Craighead County, Arkansas, by its order of July 31, 1985.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council for the City of Jonesboro, Arkansas:

 

Section 1: The territories and lands annexed to the City of Jonesboro, Arkansas by order of the Quorum Court of Craighead County, Arkansas filed June 28, 1985 be and are hereby accepted by the City of Jonesboro, Arkansas, and the territory hereinafter more fully described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more fully described as follows: (Maxie Stem - Dennis Zolper)

 

Part of the Northwest Quarter, Southwest Quarter, Section 27, Township 14 North, Range 4 East, to wit: From the Northwest Corner of the Said Northwest Quarter, Southwest Quarter, run South 89°46’ East 382.0 feet to the point of beginning, then continue South 89°46’ East 95.0 feet; then run South 01°05’ West 200.0 feet; then run North 89°46’ West 95.0 feet; then run North 01°05’ East 200.0 feet being 0.44 acres and being subject to a thirty foot wide street easement along the North boundary thereof.

 

Section 3: The lands and territories annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro and assigned and attached to Ward 6 of the City of Jonesboro,

Arkansas.

 

Section 4: The lands and territories hereby annexed to the City of Jonesboro are hereby zoned Residential (R-2).

 

Section 5: It is hereby found and declared by the City Council for the City of Jonesboro. Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that the property and the citizens of the territory described above can be entitled to fire, police, zoning, water, sewage and other protections and benefits and that these benefits and protections are urgently needed now in order to allow orderly growth and development of the lands and territories hereinabove described.

 

THEREFORE, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.

 

PASSED and ADOPTED this 19th day of August, 1985.
