PUBLIC HEARING - 6:20 P.M. - A public hearing was conducted for the purpose of establishing the Kid’s Kabbie transport service as requested by Martha McMillin. Ms. McMillin stated she would be transporting children before and after school, Monday through Friday with some Saturday work, from 6:00 a.m. to 7:30 p.m. She explained Nationwide Insurance would be insuring each van for 1.5 million dollars in coverage and each would contain fire extinguishers, first aid kits, and child safety seats. When questioned about parents being aware that she was picking up their children, Ms. McMillin explained the school would be notified along with written permission from the parents. She was questioned regarding where the business would be located and if it was zoned for commercial use. Ms. McMillin responded the business would be located at her home, 2104 Paula Drive, but was uncertain of the zoning.

 

CITY COUNCIL MINUTES - November 20, 2000

 

The Jonesboro City Council met Monday, November 20, 2000 at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk Donna Jackson, City Attorney Phillip Crego, and 12 council members. Those members were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Vice Mayor Rega presided over the meeting for Mayor Brodell who was unable to attend.

 

Councilman Tate moved, seconded by Councilman Crockett to amend the minutes from November 6, 2000, changing the wording from “third and final reading” to “second reading” on the second page first paragraph. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Tate to accept the minutes as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO RESIDENTIAL (R-3), LOCATED ON THE WEST SIDE OF CARAWAY ROAD, NORTH OF GOLF COURSE DRIVE. (LINDA KERR)

 

Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. Two local residents addressed Council regarding this matter. Mr. Doug Spear spoke in favor of the rezoning, while Mr. Mike Vanwinkle stated he could not support the ordinance since Council could not guarantee the projects site plan. A roll call vote was taken resulting in a seven to four vote in favor of the motion, with Councilman Rega abstaining from voting. Those members voting aye were: Kelton, Tate, Young, Crockett, Rorex, Perrin and Roddy. Those members voting nay were: McCall, Province, Copeland, and Moore. The motion carried. The ordinance was assigned ordinance number 3257.

 

Councilman Perrin moved, seconded by Councilman Moore to table the decision and the public hearing regarding the establishment of Kid’s Kabbie Transport Service until December 4, 2000. It was requested that Ms. Martha McMillin speak with City Attorney, Phillip Crego about the application process. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-2) TO COMMERCIAL (C-4), LOCATED AT 1900 AGGIE ROAD. (ANN WILLIAMS)

 

 Councilman Perrin moved, seconded by Councilman Roddy to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Moore moved, seconded by Councilman Perrin to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Moore for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3261.

 

Councilman Young offered the following ordinance for first reading:

 

ORDINANCE TO REZONE PROPERTY FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3), LOCATED IN THE 2200- 2300 BLOCK OF W. WASHINGTON. (RIDGE DEVELOPMENT, JACK POLING)

 

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Kelton moved, seconded by Councilman Perrin to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Crockett for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3258.

 

Councilman Young offered the following ordinance for first reading:

Councilman Perrin moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Moore to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Copeland moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE LEVYING A CITY GENERAL MILLAGE, CONSISTENT WITH THE PLEDGE MADE DURING THE SALES TAX CAMPAIGN.

 

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. Councilman Rorex moved to amend the ordinance by deleting Section 1. The motion failed for lack of a second. Councilman Rorex stated it was a breach of contract with what the people voted on regarding the 1% sales tax in July. City Clerk, Donna Jackson explained it was exactly what was promised with the passage of Ordinance No. 3223. In Section 1 of Ordinance No. 3223 it reads: “Section l. That the city’s sanitation domestic refuse fee, and mosquito control fee and the 2.1 mill general city property tax shall each be repealed upon the approval of a one percent (1%) city sales and use tax at the July 18, 2000 special election. The effective date of repeal shall be the date that the sales and use tax first imposed and collection begins.” (October 1, 2000)

 

City Clerk Jackson explained that the 2.1 mills was stopped October 1st, 2000 as promised, leaving a nine month period in which the 2.1 mills was to be collected for the year 2000. She explained that Arkansas State Law does not allow municipalities to collect millage for 9 months and not collect it for the remaining three months that it must be collected for the full twelve month period. To meet the state requirement, 75% of the 2.1 mills, or 1.575 was levied for the year 2000. A voice vote was taken resulting in all members voting aye with the exception of Councilman Rorex who voted nay. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Tate to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye with the exception of Councilman Rorex who voted nay. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Perrin moved, seconded by Councilman Crockett for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye with the exception of Councilman Rorex who voted nay. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3260.

 

The following millage resolutions were considered by Council:

 

•Fire - Councilman Kelton moved, seconded by Councilman Moore for the adoption of the resolution. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:46.

 

•Police - Councilman Perrin moved, seconded by Councilman Young for the adoption of the resolution. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:47.

 

•Library - Councilman Young moved, seconded by Councilman Tate for the adoption of the resolution. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:48.

 

Councilman Kelton moved, seconded by Councilman Crockett to set an appeal hearing for 6:10 p.m. on December 4, 2000 regarding the recommendation of the Metropolitan Area Planning Commission to deny a zoning change from Agricultural (AG-1) to Residential (R-1), located on the east side of Kathleen Street, north of Morton Drive. (C.M. Mooney and Jay Harmon). A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Under new business, Councilman Tate moved, seconded by Councilman Roddy for the adoption of a traffic resolution placing the following traffic signs with in Jonesboro:

 

STOP SIGNS:

For eastbound and westbound traffic on Rosemond Ave. at Dupwe Dr., making the intersection a 4-way stop.

 

SPEED LIMIT SIGNS:

25 M.P.H. on Cherrywood Drive from Vail Drive to Springwood Drive.

 

NO PARKING SIGN:

On the west side of Bowling Lane, 400 feet from the northwest corner of Catalina Cove, in front of University Heights Elementary School, during school days between the hours of 7:30 a.m. to 3:30 p.m.

 

Councilman Rorex moved to amend the 25 M.P.H. speed limit sign to 30 M.P.H. The motion failed for lack of a second. A voice vote was taken resulting in all members voting aye with the exception of Councilman Rorex who voted nay. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned resolution number 2000:49.

 

Council requested a 30 M.P.H speed limit sign be posted at Broadmoore and Rosemond by Street Superintendent, Gene Barnett. Mr. Barnett stated no one seemed to be checking for duplications in the requests for traffic signs and that he was not receiving any notification when traffic signs are adopted. City Clerk, Donna Jackson stated she would see that the Street Department was provided copies of all traffic resolutions.
